(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF JANUARY 19, 1981. REPORT NO. : P-16-81 SUBJECT: Objection to By-law Number 80-148 (R. and G. Sucee) Our File: Z-A-1-15-8 RAr ynPnTTMn The attached By-law Number 80-148, which was approved by Town Council on November 3, 1980 amends the Restricted Area (Zoning) By-law of the former Township of Darlington to permit the development of an eleven lot draft approved estate residential subdivision in Burketon Station. In accordance with Provincial regulations, the By-law was circulated to owners of property within 400 feet of the lands to be rezoned, and the attached letter of objection was submitted by Mrs. Rilda Hughes within the 21 day objection period prescribed by these regulations. Mrs. Hughes' objection is not related directly to the proposed develop- ment, but rather to what she feels are unsatisfactory conditions in Burketon Station - the lack of soft services, vandalism, high taxes; and the condition of existing roads. None of these conditions would be exacerbated by the development of the proposed subdivision. J 45) - 2 - The Ontario Municipal Board's Revised Rules of Procedure require Council to review the objections filed in response to the circulation of any By-law and to forward a statement of its position in respect of such objections to the Board. It is not necessary to include reasons to support this position. COMMENT: It is the opinion of staff that the objection filed by Mrs. Hughes does not warrant the repeal or amendment of By-law 80-148, but should instead be considered by the Ontario Municipal Board in its evaluation of the By-law. RECOMMENDATION: It is respectfully recommended. 1. That this report be received for information; 2. That the Ontario Municipal Board be advised that the Council of the Town of Newcastle has reviewed By-law 80-148 in light of the objection filed, and wishes to proceed with the said By-law, as approved by Council on November 3, 1980, and 3. That staff be authorized to attend any Ontario Municipal Board Hearing which may be held in respect of the said By-law, accompanied by the Town's Solicitor, if deemed necessary; 4. In the event that the appeal is not successful, that staff be authorized to request the Ontario Municipal Board to award the Town of Newcastle an amount equal to the Town's costs in respect of the said Hearing; and - 3 - 5. That a copy of this report be forwarded to the objector for information.
