REPORT NO. : P-12-81 SUBJECT: By-law 80-80 -- Corporation of the Township of Scugog BACKGROUND: By-law 80-80 of the Corporation of the Township of Scugog was forwarded to the Planning and Development Department on December 4, 1980. The By-law rezones a parcel of land in the former Township of Reach to permit the development of highway commercial uses. COMMENT: The subject parcel is located in Lot 1, Concession 9 of the former Township of Reach and does not affect the interests of the Town of Newcastle. Accordingly, no action on the rezoning by-law was required. The last date for filing objections was December 23, 1980. December 15, 1980 Dir ctor of Planning EXPLANATORY NOTE To Restricted Area By-Law No . 80-80 Passed By The Council of the Corporation of The Township of Scugog . LANDS AFFECTED: Restricted Area By-law No. 80-80 applies only to certain lands, encompassing a total area of approximately 6 hectares (15 acres) located in part of Lot 1, Concession 9, on the south-east corner of the intersection of Highway No. 47 and Regional Road No. 23, in the Township of Scugog, in the Regional Municipality of Durham (formerly in the Township of Reach, in the County of. Ontario). PRESENT ZONING: Restricted Area By-law No. 1886, as otherwise amended, presently places the subject lands partly within the General Agricultural (A.2) Zone and partly within the Flood (F) Zone. PROPOSED ZONING: Restricted Area By-law No. 80-80 will place the subject lands partly within the Highway Commercial Exception.Two (C2-2) Zone and partly within the Flood Exception One (F-1) Zone, all in accordance with Schedule "All attached thereto. PURPOSE OF BY-LAW: . The purposes of Restricted Area By-law No. 80-80, are: 1. To place the subject lands partly in the Highway Commercial Exception Two (C2-2) Zone, and partly in the Flood Exception One (F-1) Zone, all in accordance with Schedule "All attached to and forming part of Restricted Area By.-law No. 80-80. 2. To permit certain commercial uses, such as .a motel, eating establishment, dance hall, liquor licensed premises, banquet facilities and motor vehicle service station, within that portion of the subject lands zoned Highway Commercial Exception Two (C2-2), and to establish standards to govern such uses. The uses permitted and the proposed standards are contained in Section 2 of Restricted Area By-law No. 80-80. On Appendix No. I attached to this Explanatory Note is the Proposed Site Plan which details the location of' the proposed buildings and their intended uses. It should be .noted that this Appendix No. I is for information only and does not form pa-.t of Restricted Area By-law No.: 80-80. There may be changes to the layout of the buildings,' as .a result .of detailed engineering approvals of the development. Any development of the subject lands will necessitate the execution of a formal Development Agreement with the Corporation under the authority .of Section 35a.of The Planning Act. 3.. To prohibit buildings, structures and uses within the area zoned Flood Exception One (F-1) Zone, except where such are required for flood control purposes. One ingress an I d egress driveway to Regional Road No. 23 will, however, be permitted. The location of any permitted uses must be approved by the Ministry of Natural Resources and/or the appropriate Conservation Authority. EFFECT OF BY-LAW: If approved, Restricted Area By-law No. 80-80 will place the subject lands partly in the Highway Commercial Exception Two (C2-2) Zone and partly in the Flood Exception One (F-1) Zone, and will permit the development of the subject lands for highway oriented commercial uses, in accordance with the standards contained therein. TAKE NOTICE that the Council of the Corporation of the Township of Scugog intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 35 of The Planning Act for approval of By-Law #80-80, passed on the 24th day of. November , 1980. A copy of the by-law is furnished ' herewith and a note giving an explanation of the purpose and effect of the by-law and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY, within twenty-one (21) days after the date of , this notice, send by registered mail or deliver to the clerk of the Town- ship of Scugog notice of objection to approval of the said by-law or part thereof giving details of all or the portion of the by-law to which you object and detailed reasons therefor, and shall indicate that if a hear- ing is held the objector or an agent will attend at the hearing to support the objection. ANY PERSON wishing to support the application for approval of the by-law may within twenty-one (21) days after the date of this notice. send by registered mail or deliver to the clerk of the Township of Scugog notice of his support of approval of the said by-law together with a request for notice. of any hearing that may be held giving also the name and, address to 'which such notice should be given. THE ONTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a time and place when any objection to the by- law will be considered. Notice of any hearing that may be held will be given only to persons who have filed an objection or notice of support and who have left with or delivered to the clerk undersigned, the address to which notice of hearing is to be sent and, similarly, to any person who has filed a request for a change in the provisions of the by-law.
