REPORT NO. : P-6-81 SUBJECT: Application for Rezoning Number Z-A-1-1-6 Proposed Redesignation of Road Allowance in Lot 7, Concession 4, former Township of Darlington John Higginson BACKGROUND: The subject application requests an amendment to the Darlington Zoning By-law to change the designation of an 800.0 metre (2625.0 feet) section of road located in Lot 7, Concession 4, Darlington, from a Class "B" Public Street to a Class "A" Public Street. The pro- posed rezoning would permit the erection of buildings and structures on lots which have frontage on the subject road allowance, provided that all other requirements of the By-law could be complied with. The proposed redesignation was considered by the Town of Newcastle Works Committee at its meeting of September 30, 1980, and the following recommendation was submitted to Council, and subsequently adopted: t- E "THAT, the road allowance in Lot 7, Concession 4, former Township of Darlington, as defined on key map 20 of By-law 2111, be redesignated as a Class 'A' Public Street, and the said by-law be amended accordingly." � � 2 - The application was circulated to the Central Lake Ontario Conservation Authority for comment. The Authority had sub- mitted the following: "The Authority has no objection to the road in question being reclassified as a Class A Public Street and the issuance of building permits fronting on the relevant road allowance areas. The Authority's acquisition plan for the Stephen's Gulch Conservation Area extends as far as the road allowance between lots 6 and 7, con- cession 4. Therefore, the lands in question are not affected in this regard. The southern quarter of lot 7, concession 4 is located in the schedule of Ontario Regulation 824/73 and therefore no filling or grading is permitted without written authority approval in affected areas of lands in question. A small tributary of the Soper Creek flows south of the subject road allow- ance near the western limit of lot 7. No alterations to the channel of this watercourse are permitted without Authority approval." In addition, the Town of Newcastle Public Works Department has stated that prior to 1974, the relevant section of road was recon- structed and is therefore not deficient. However, because the Council of the former Township of Darlington did not amend the Zoning By-law to recognize the present status of the road, the road retained its designation as a Class "B" Public Street. Since Section 4 (f) of the Darlington Zoning By-law prohibits the erection of any building or structure on lots abutting a Class "B" Public Street, building permits have not been available for these lots. 3 - COMMENTS: Because the road allowance has been reconstructed and is not in a deficient state and because the proposed redesignation has been authorized by the Newcastle Public Works Committee, we would have no objections to the proposed redesignation of this road. RECOMMENDATION: It is respectfully recommended: 1. That Application for Rezoning Number Z-A-1-1-6 be approved, and that the attached By-law 81- be forwarded to Council for approval. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend Restricted Area By-law Number 2111, as amended, of the former Township of Darlington. NOW THEREFORE the Council of the. Corporation of the Town of Newcastle ENACTS as follows: 1. Key Map 20 of Schedule 'A' to By-law 2111, as amended, is hereby further amended by changing to CLASS 'A' PUBLIC STREET the zone designation of that part of the road allow- ance in Lot 7, Concession 4, shown as "CHANGE TO CLASS 'A' 0 PUBLIC STREET" on the attached Schedule "X" hereto. 2. This By-law shall come into effect on the date hereof, subject to the provisions of Section 35(10) of the Plan- ning Act. BY-LAW READ a first time this. 12 day of January A.D. 1981.
