REPORT NO. : P-183-80 SUBJECT: Application for Rezoning Number Z-A-1-15-8 and Proposed Subdivision Agreement for Draft Approved Plan of Subdivision Number 18T-76063 - R. & G. Sucee, Part of Lot 20, Concession 10, former Township of Darlington - Our File: S-D-1-15-2 BACKGROUND: On January 18, 1980, the Minister of Housing granted Draft Approval to Application for Subdivision Number 18T-76063, to permit the development of the subject 9.5 hectare parcel of land for 11 estate residential lots, subject to the fulfillment of certain conditions. Among these conditions of draft plan approval were requirements that the land be appropriately zoned in the applicable Restricted Area (Zoning) By-law; that up to 5% of theland in the Plan, or cash-in-lieu thereof, be dedicated to the Town for park purposes under the provisions of Section 33(5) (a) of the Planning Act; and that the proponent enter into a subdivision agreement with the Town. COMMENTS: 1. Draft Subdivision Agreement The attached draft subdivision agreement has been prepared by staff to satisfy the conditions of draft plan approval and to safeguard the V r�, - 2 - Town's interests in respect of the development of this site. The agreement follows the standard format used for subdivisions which will not be provided with full municipal services. Special provisions have been included to insure that lot grading, drainage, tree removal, and house location on this site will be controlled by the Central Lake Ontario Conservation Authority and the Town, and that a water reservoir for fire fighting purposes will be provided within the limits of the subdivision. The agreement also requires the staging of the development of the subdivision, with improvements to Darlington Boulevard being required prior to the release of the lots in the second stage. This draft agreement, which has been prepared by the applicants' sol- icitor has been revised to implement the conditions of draft plan approval and to incorporate comments sub- mitted by Town staff. It would now be appropriate to forward this agreement to Council for execution. 2. Application for Rezoning Number Z-A-1-15-8 The site is presently zoned "Deferred Development" in Restricted Area By-law Number 2111, as amended, of the former Township of Darlington. An amendment to the By-law, which would restrict the uses permitted within the subdivision to residential and accessory uses, would be required to satisfy condition 7 of draft plan approval of the subject plan. The attached By-law would permit the use of the land for 11 single family dwellings. i 3 - RECOMMENDATION: It is respectfully recommended: 1. That this report be received for information; 2. That the Planning and Development Committee recommend that the attached subdivision agreement for the Sucee subdivision be executed by Council; 3. That the Town Clerk be requested to prepare a By-law for the purposes of authorizing the execution of the agreement, to be presented to the November 3, 1980 meeting of Council; 4. That application for rezoning Number Z-A-1-15-8 be approved; 5. That the attached By-law Number 80- be forwarded to Council for approval; and 6.
