SUBJECT: Application for Rezoning Number Z-A-2-12-5
Part of Lot 9, Concession 1, former Town of
Bowmanville - Mrs. Robyn Rejczak
BACKGROUND:
The subject application requests an amendment to the Bowmanville
Zoning By-law to rezone a 1493.0 square metre (16,070 square feet)
parcel of land fronting Mearn's Avenue in the Town of Bowmanville.
The applicant intends to rezone this site for residential purposes.
The site is designated "Residential" in the Region of Durham
Official Plan. The proposed residential development is permitted under
this land use designation. Section 8.1.3.1 of the Plan would allow resi-
dential development in areas which are fully serviced by municipal water
and sewage systems. In this regard, the proposal would conform to the
policies of the Durham Official Plan.
The site is presently zoned "D Deferred Development" in the Bowmanville
Zoning By-law. The proposed By-law would change the zoning of this property
to "R Residential" in order to permit the erection of a single family
dwelling.

The application was circulated to the Durham Planning and Works
Department, the Central Lake Ontario Conservation Authority, Bowmanville
Public Utilities Commission, Bell Canada, Newcastle Public Works Depart-
ment, Newcastle Building Department, Newcastle Fire Department, and the
Long Range Planner for comment.
The following comments were received:
The Durham Planning and Works Department
"Please be advised that the subject site is designated "Residential"
in the Durham Regional Official Plan and the Official Plan of the
former Town of Bowmanville P1aniaing Area. The proposed residential
use conforms.
With respect to Regional services, sanitary sewer and water supply
services are available for the proposed residential dwelling unit
to be located on the subject lands. In addition, we wish to advise
that a sanitary and water service connection were installed to the
property line under the Region's contract for the trunk sanitary
sewer and watermain on Mearns Avenue which were constructed earlier
this year.
At such time as the owner/developer applies to the Region for con-
nection permits, they will be assessed the applicable costs for the
aforementioned service connections installed by the Region to service
the property."
Bell Canada
"No objection."
Central Lake Ontario Conservation Authority
"The site of this proposed rezoning has been reviewed. Based on
available information, we find the Authority has no objection to
applicant's intentions."
Bowmanville Public Utilities Commission
"We have reviewed the property in question and have',objections to
the rezoning application and again wish to thank you for keeping
us informed in these matters."
Newcastle Public Works Department
"We have no objection to the proposed rezoning, however, we do
recommend as a condition of rezoning that a 10 foot road widening
be dedicated to the Town."

Newcastle Building Department
"No objection."
Newcastle Fire Department
"No objection."
Long Range Planner for the Town of Newcastle
"The proposed rezoning conforms to the relevant policies of the
Durham Regional Official Plan, the Bowmanville Official Plan
and the Soper Creek Neighbourhood Plan. Therefore, there would
be no objection to this rezoning."

COMMENTS:
Staff have reviewed the proposal submitted by Mrs. Rejczak and
feel that since this application consists of the addition of one resi-
dential lot in this area, there would appear to be no adverse effect
on the existing uses in this area.
Because of this reason and the fact that the proposal would not
conflict with the policies of the Region of Durham Official Plan and
the Official Plan of the former Town of Bowmanville, we would have no
objection to the subject application for rezoning.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received; and
2. That the attached by-law be recommended to Council for
approval at such time as the required 10 foot road widening
on Mearn's Avenue is dedicated to the Town.
