Connell - Our File: S-P-2-17 BACKGROUND: As members of Council are aware, the Town has required Mr. K. Connell, Owner of Bowmanville Zoo to enter into a Site Plan Agreement for the purposes of identifying those uses on the property which are to be recognized as "legal non-conforming". The attached Site Plan Agree- ment executed by Mr. Connell indicates that certain uses are legal non- conforming under the existing "OS" "Open Space" zoning. The Agreement further specifies that any expansion or enlargement of the buildings or structures recognized under the Agreement will require an application . for minor variance through the Committee of Adjustment or an application for rezoning. The Owner will be required to obtain a licence under by-law 75-34 to operate a "tourist camp" on the property. COMMENT: The Site Plan Agreement for the Connell property is accompanied by a proposed by-law amending the Tourist Camp Licencing By-law 75-34. �c - 2 - The amending by-law is proposed in order to allow the execution of the agreement with Mr. Connell and agreements with other operators of existing "Tourist Camps". During the review of the Connell application it was felt by staff that certain provisions of by-law 75-34 were not applicable to the site. The proposed amending by-law would allow for deviations from the standards of by-law 75-34 provided that the Owner enters into a Site Plan Agreement with the Town. By-law 75-34 is thereby more flexible. RECOMMENDATION: 1. That this report be received by Council, and 2. That by-law 75-34 be amended by the approval of the attached by-law, and 3. That Council approve the agreement with Mr. K. Connell and authorize the exection of the agreement by adopting the attached by-law for that purpose. Respectfully submitted, DNS:lb D. N. Director of Planning THE CORPORATION OF THE TOWN OF NEWCASTLE By-law Number 80-131 a By-law to amend By-law 75-34, of the Town of Newcastle, being a By-law enacted under The Municipal Act to Licence, regulate and govern the operation of Tourist Camps in The Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it expedient to amend By-law 75-34; NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1. Subsection (1) LAND USE of Section 5 DEVELOPMENT PROVISIONS is hereby deleted in its entirety and replaced with the following: " (i) LAND USE NO land in a tourist camp shall be used for any purpose other than the purposes shown on the most recent site plan of such tourist camp which has been approved by the Corpor- ation. The following provisions in respect of development shall be required of all existing or new tourist camp pro- posals except in those instances where the proponents enter into a development agreement with the Town of Newcastle. In such instances, the following provisions may be required in whole or in part as may be reflected through the said development agreement:" Approval 2 - 2. Y The Council of the Corporation of the Town of Newcastle hereby ENACTS as follows: THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Town of Newcastle and seal the Corporation Seal an Agreement between E. K.
