SUBJECT: By-law 60-80 - Township of Scugog
BACKGROUND:
By-law 60-80 of the Township of Scugog was forwarded
to the Planning and Development Department September 24, 1980. The
By-law amends Restricted Area By-law Number 6-80 by changing from the
Environmental Protection (EP) Zone to Resort Commercial (RC) Zone a
parcel of land located on Platten Island in the Township of Scugog.
COMMENT:
'The subject land is in Lot 3, Concession 10 of the
former Township of Scugog and does not affect the interests of the Town
of Newcastle. Accordingly, no action on the rezoning by-law is required
by the Town. The last date for filing objections is October 14, 1980.
RECOMMENDATION:
That the Planning and Development Committee recommend
to Council:
1. That By-law 60-80 of the Township of Scugog be received
and filed.

NOTICE OF APPLICATION to The Ontario Municipal Board
by The Corporation of the Township of Scugog for
approval of a by-law to regulate lance use passed

pursuant to -Section 3S of The Planning Act.
TAKE NOTICE.that the Council of the Corporation of the 'Township of Scugog
-intends to.apply to The Ontario Municipal Board pursuant to the provisions
of Section 35 of The Planning Act for approval of By-La€i #60-80 passed
on the 8th day. of September , 19 8 U A copy of the by-law is furnished
herewith and a note giving an explanation of the .purpose and effect of the
by-law and stating the lands affected thereby is also. furnished herewith.
ANY PERSON INTERESTED MAY, within twenty-one. (21) days after the date of
this notice, send by registered mail or deliver to the clerk of the Town-
ship of Scugog notice of objection to approval. of the said by-law or part
thereof giving details.of all or the-portion of the by-law to which you
object and detailed masons therefor, and shall indicate that if a hear-
ing is .held the objector or an agent will attend at the hearing to support
the objection.
ANY -PERSON wishing to support the application for approval of the by-law
may within twenty-one (21) days after the. date of this notice send by .
registered mail or deliver to the clerk .of the Township of Seugog notice
of his support of approval of the said by-law together with a request
for. not ice: of any. hearing that may.be held giving also the-naze and
address to which such notico'should be given.
THE ONTARIO MNICIPRL BOARD may approve of the said by-law but before
doing so it may appoint a time and place when any objection to the by-
'law will be considered. Notice of any hearing that may be held will be
.given only to persons who have filed an objection or notice of support
and ,who have left with or delivered[ to. the clerk undersigned, the address
to which notice of hearing is to be scant and, similarly, to any person
who has filed a request for a change in the provisions of the by-law.
THE LAST DATE FOR FILING OBJECTIONS will be October 14th , 19 80 .

EXPLANATORY NOTE
Purpose of
Attached By-Law: The attached by-law serves to amend
Restricted Area By-Law #6-80, of the Corporation
of the Township of Scugog. By-Law # 6-80 was
enacted January 28, 1980 to regulate the
development and use of certain lands for the
purpose of the camping establishment, a marina
and various other ancillary uses .
Location of- Lands
.Affected:: The. ,lands under _consideration are ,located on
Part of Lots 2 and 3, Conc. 10, Ward III of
` the Corporation of the Township of Scugag .
More specifically; the Iands may be`-described
a s those lands- adjacent the more north easterly
limit 'of P1-atten Island and those larfds located
to- the south of the canal forming Part of Lot 3 ,
Conc. 10. , Specific reference should be made to
the Zone Map, attached to and forming part of
the amending by-law, for delineation of the
lands under consideration.
Affect of Amending
By-Law: The effect of the attached by-law is twofold
insofar as it serves to correct an inadvertent
error with regards to the boundaries of the
lands affected by By-Law #6-80 and to rezone: a
portion of Lot 3, Conc . 10 , south of the canal
from the Environmental. Protection (EP) Zone to
the Resort Commercial (RC) Zone.
Upon circulation of By-Law 6-80 it became
apparent that lands not owned by the applicant
had been zoned under the provisions of said by-
law— Council upon reviewing this matter with
the operator of the establishment confirmed
the boundaries of the lands to be developed and
uses in conjunction with the Resort Commercial
operation and has enacted the attached by-law
to. clarify same .
Council has further been advised by the Ministry
of Natural Resources that fill has been placed
on those lands south of the canal in Part of
Lot 3, Conc . 10, zoned within an Environmental
Protection (EP) Zone in accordance with that
Ministry ' s designated recommendation. Accordingly,
Council considers it advisable to further amend
By- Law 6- 80 insofar as is necessary to rezone
such lands within the Resort Commercial (RC) Zone .

boundaries of the lands affected by the said By-law;
AND WHEREAS the Council of the Corporation of the
Township of Scugog has reviewed this matter further with the

owner/operator of the . e.stablishment and has determined that the
boundary of the lands affected by By-law Number 6-80 in the vicinity '{
of the more north-easterly limits of Platters Island is incorrect !
and further deems it advisable to amend Restricted Area By-law
Number 6-80 insofar as is necessary to' correct this inadvertent
error,'

Township of Scugog has further been advised by the Ministry of

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SCUGOG Enacts As Follows:
1. THAT Schedule "A", the Zone Map, of Restricted Area By-law
( � Number 6-80 of the Corporation of the Township of Scugog, be
and the same,'_-is hereby amended insofar as is necessary to

delete reference to those ,lands forming the more north-
easterly -portion. of'_Platten_Island, . and, , to correct the
