(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF SEPTEMBER 29, 1980. REPORT. NO. : P-160-80 SUBJECT: Proposed Subdivision Agreement - Draft Approved Plan of Subdivision Number 18T-78107 - Ralph Davis Our File No. S-D-1-13-2 BACKGROUND: The subject application, proposing the development of an 8.38 hectare parcel of land in the north-west quadrant of Solina for eight single family lots, a park block and a block for future development, was draft approved by the Minister of Housing on March 20, 1.079. Included among the conditions of draft approval of the subdivision were require- ments that the land be appropriately zoned in the applicable Restricted Area (Zoning) By-law, and that the Owner enter into a subdivision agree- ment with the Town of Newcastle and the Region of Durham. By-law Number 79-36, which rezoned the site to permit the develop- ment of the proposed subdivision was approved by the Ontario Municipal Board on July 27, 1979. COMMENT: The attached subdivision agreement has been negotiated by Town staff in accordance with the terms and conditions recommended by Town. Council and approved by the Ministry of housing. - 2 - The agreement follows the standard format used for subdivisions which will be serviced by individual wells and septic tanks. The southerly 142 metres of Hillside Drive in the Ashton Subdivision serves as a common access to both the Ashton and Davis sub- divisions. Provision has been made in this Agreement, as well as in the subdivision Agreement which was negotiated in respect of the Ashton sub- division for the construction of this portion of Hillside Drive to service both subdivisions, with fifty percent of the costs of construction to be bourne by each landowner. The Agreement also provides for the payment of cash-in-lieu of the five (5%) percent parkland requirement required by the conditions of draft plan approval. Block 9, the block proposed for park purposes on the draft plan, as well as Block 10, a Block proposed for future development, leave been listed in the Agreement as lands which are unsuitable for building purposes at this time. The conditions which must be satisfied before the development of these Blocks would be permitted are listed in Schedule "N" to the Agreement. RECOMMENDATION: It is respectfully recommended: 1. That Report P-160-80 be received for information; 2. That the Planning and Development Committee recommend that the attached subdivision Agreement for the Ralph Davis subdivision be executed by Council; and 3. That the Town Clerk be requested to prepare a By-law for 3 _. the purposes of authorizing the execution of the Agreement, to be presented to a subsequent meeting of Council.
