SUBJECT: Application for Rezoning Z-A-1-6-6
Part Lot 31, Con. 2, Darlington
(Mr. D. Croth)
BACKGROUND:
The above mentioned application was submitted to the Planning and
Development Department in conjunction with two applications for sever-
ance. The applicant owns a . 86 acre parcel of land on the south side
of Nash Road in Courtice and wishes to sever two residential lots with
50 feet frontages from the subject land leaving the existing dwelling
unit and garage on the remaining land. The applicant is also making
provision for the dedication of an easement to the Town of Newcastle for
the provision of storm sewers. The storm sewer easement has been required
as a condition of the now approved severances, and is part of the overall
easement requirements for the watershed of the Courtice Heights (North)
subdivision. The severances have also been approved on the condition that
the lots be appropriately zoned as per the subject rezoning application.

Durham Regional Planning:
"The subject site is designated "Residential" in
the Durham Regional Official Plan. The Plan requires
that residential areas shall be fully serviced by
municipal water and sewage systems. Proposed rezoning
would appear to conform provided that the by-law in-
cludes a provision requiring that development be on
full municipal services.
Sanitary sewer service is available from an existing
sanitary sewer fronting the above-noted lands on
Nash Road."
Durham Regional Works:
"With respect to Regional services, there is a 600 mm
(24") diameter watermain (feeder) located on Nash
Road across the frontage of the subject site. Regional
policy, however, does not allow individual domestic
connections to feedermains of this size because the
occurrance of a leak at the union of the service con-
nection and the feedermain would require that the
main be "shut down" thereby affecting the domestic
and fire flow supply to local mains in the area.
Therefore, in order to service the subject site with
piped water, the owner will be responsible for the
construction of a 150 mm (6") diameter watermain on
Nash Road easterly from Goldpine Ave. (proposed in
draft approved plan of subdivision 18T-76048) to
the east limit of subject parcel."
Central Lake Ontario Conservation Authority:
No objection.
Ontario Hydro:
". . .We have no objection to the intent of the requested
rezoning, we advise that the applicant must contact
the address shown below to secure the release of Ontario
Hydro's easement on the property concerned."
(Staff have advised the applicant of this requirement
and have been in turn advised by the applicant that
appropriate action has been taken) .
Newcastle Works:
No comment.
Long Term Planning (Newcastle) -..
No objection.

COMMENT:
Staff have reviewed the subject application and have no objection
to the proposal. Staff note that the proposal conforms to the policies
of the Durham Regional Official Plan and Amendment 12 to the Darlington
Township Official Plan.
It should be noted that the subject lots can only be developed at
such time as full municipal services are available to the properties,
as required in the attached by-law. The attached by-law contains urban
development standards similar to those in effect in other areas of Courtice,
typical of fully serviced urban areas. Staff note also that there is no
reverse frontage requirement for new lots on Nash Road under Amendment 12
to the Darlington Official Plan.
RECOMMENDATION:
It is recommended that the attached by-law be forwarded to Council
for approval at the next regular meeting.

By-law Number 80-127.
A By-law to amend Restricted Area By-law Number
2111, as amended, of the former Township of
Darlington.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1. Map 21 of Schedule "A" to By-law 2111, as amended, is hereby further
amended by changing to SPECIAL PROVISION BY-LAW 80-127the zone desig-
nation of the lands designated "ZONE CHANGE TO SPECIAL PROVISION
BY-LAW 80-1271 on the attached Schedule "X" hereto.
2. Section 13 of By-law Number 2111, as amended, is hereby further
amended by adding thereto the following subsection 'W' :
"(W) Part of Lot 31, Concession 2
Notwithstanding any provisions of this By--law to the contrary,
that portion of Lot 31 designated "SPECIAL PROVISION BY-LAW 80- 127
on the attached Schedule "A" hereto shall be used only in accord-
Ance with the following provisions:
(1) Permitted Uses
(i) . One single-family detached dwelling and
structure accessory thereto on a fully serviced
_lot.

(2) Lands Subject to Flooding
No person shall erect any building or structure within
the flood plain limits of the Farewell Creek and the
Black Creek, as designated by the Central Lake Ontario
Conservation Authority, without the written permission
of the Central Lake Ontario Conservation Authority.
(3) Zone Provisions
(a) Lot Area (minimum) 836.0 square metres
(b) Lot Frontage (minimum) 15.0 metres
(c) Front Yard (minimum) 6.0 metres
(d) Interior Side Yard (minimum) 1.8 metres, pro-
vided that where an
attached garage or
carport is provided,
the minimum sideyard
shall be 3.7 metres
on the driveway side;
(e) Rear Yard (minimum) 7.5 metres
(f) Gross Floor Area (minimum) 88.0 square metres
(g) Building Height (maximum) 10.0 metres
3. This By-law shall come into effect on the date hereof subject to
the provisions of Section 32 (25) of the Planning Act.
