REPORT NO. : P-145-80 SUBJECT: By-law 75-80 - City of Oshawa BACKGROUND: By-law 75-80 of the Corporation of the City of Oshawa was for- warded to the Planning and Development Department on August 14, 1980. The By-law rezones a parcel of land in the City of Oshawa to permit a two storey building containing an assembly hall, a credit union office and one apartment unit. COMMENT: The subject parcel fronts on the north side of Jackson Avenue in the City of Oshawa, and, therefore, does not affect the interests of the Town of .Newcastle. Accordingly, no action on the rezoning by-law has been taken. The date for filing objections was September 3, 1980. RECOMMENDATION: That the Planning and Development Committee recommend to Council: 1. That By-law 75-80 of the City of Oshawa be received for infor- mation and filed. Respectfully submitted, EP:lb D. August 22, 1980 Director of Planning . ;T NOTICE OF APPLICATION TO THE ONTARIO MUNICIg)� BY THE CORPORATION OF THE CITY OF OSHAWA FOR APPROVAL OF A BY-LAW TO REGULATE LAND USE PASSED PURSUANT TO SECTION 35 OF THE PLANNING ACT TAKE NOTICE that the Council of The Corporation of the City of Oshawa intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 35 of The Planning Act for approval of By-law Number 75-80 passed on the 28th day of July.1980. A copy of the by-law is furnished herewith. A note giving an explanation of the purpose and effect of the by-law. and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this notice, send by registered mail or deliver to the Clerk of the City of Oshawa notice of objection to approval of the said by-law or part thereof giving details of all or the portion of the by-law to which you object and detailed reasons therefor, and shall indicate that if a hearing is held the objector or an agent will attend at the hearing to support the objection. ANY PERSON wishing to support the application for approval of the by-law may within twenty-one (21) days after the date of this notice send by registered mail or deliver to the Clerk of the City of Oshawa notice of his support of approval of the said by-law together with a request for notice of any hearing that may be held giving the name and address to which such notice should be given. THE ONTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a time and place when any objection to the by-law will be considered. BY-LAW NUMBER 75-80 OF THE CORPORATION OF THE CITY OF OSHAWA being a by-law to further amend By-law Number 3415 of the City of Oshawa . BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of The Corporation of the City of Oshawa by the Council thereof as follows: 1 . By-law Number 3415 be and the same is hereby further amended by amending Schedule "A" thereof by adding Special Condition 11 as set out in Schedule "B" to this by-law. 2 . Sheet Number 9 of Appendix "A" to ley-Law Number 3415, as amended, is hereby further amended by changing the land use designation for two parcels of land, located on the north side of Jackson Avenue, municipally known as 18 Jackson Avenue and 38 to 42 Jackson Avenue and described as Part 1 and Part 2 according to Plan 40R-5773 (shown hatched and marked R-4 with the figures "11" encircled) from M-1B to R-4 and making the lands designated R-4 subject to Special Condition "11" so that Sheet Number 9 shall be amended as shown on the revised Sheet Number 9 attached hereto as Schedule "A" . 3. Schedules "A" "B" and "C" attached hereto form part of this by-law. 4. No part of this by-law shall come into force without the approval of The Ontario Municipal Board but subject thereto this by-law shall take effect from the date of its passing. S�,1IT f V15T54S TO TNF POUN04 atI50r ANY USi ZONING MAP r l OISTR ICT,S/( PART 11,patAg-ph 3(t) .O, IV q SCHEDULE "B" TO BY-LAW NUMBER 75-80 PAS ED THIS 28th DAY OF July 1980 CLERK SPECIAL CONDITION 11 Two parcels of land located on the north side of Jackson Avenue municipally known as 18 Jackson Avenue and 38 to 42 Jackson Avenue, described as Part 1 and Part 2 according to Plan 40R-5773, as shown .on Schedule "A" hatched and marked R-4 with the figures "11" encircled shall be subject to the . special regulations hereinafter contained and where there is any conflict between the regulations hereinafter set out and any other provisions of this by-law or By-law Number 55-73, these special regulations shall apply, but in the event that this Special Condition is silent on any matter, the provisions applicable to a R-4 use district shall apply: 1 . 1 Defined Area: The areas subject to this Special Condition are as shown in Schedule "A" hereto, outlined in a heavy line and hatched with the figures "ll ". encircled . 1 . 2 Permitted Uses The lands subject to this Special Condition as shown on Appendix "A" to Special Condition 11 shall not be used for any purpose except as follows: Site A. a assembly hall (b) museum ( c) library ( d) one, two bedroom apartment (e) credit union office ( f) school (.g) any accessory use Site B Za sparking lot with a minimum of 38 parking spaces ( b) bulk refuse collection facility 1 . 3 Lot Requirements: The zoning regulations for the lands subject to this Special Condition, as shown on Appendix "A" to Special Condition 11 shall be as follows: Site A (a) front yard depth (minimum) 3 . 5 meters . _ (b) side yard depth (minimum) 2. 45 meters (c) building height (maximum 10. 6 meters (d) lot coverage (maximum) 71 . 0% Site B a lot frontage (minimum) 16 . 0 meters PAGE TWO OF SCHEDULE "B" 1 .4 Permitted Buildings: One, two storey building having a maximum ground floor area of 895 square meters shall be permitted on the lands shown as Site A on Appendix "A" . No buildings shall be permitted on the lands shown as Site B on Appendix "A" 1 . 5 The lands subject to this Special Condition are hereby declared to be a site plan control area within the meaning of subsection (2 ) of Section 35a of The Planning Act R. S.O. c. 349 as amended. 1 . 6 Off-Street Parking: (a) A minimum of 38 parking spaces shall be provided in the lands shown as Site B on Appendix "A" . All other , parking requirements shall be governed by the Oshawa Off-Street Parking By-law 55-73 , as amended; 1. 7 Appendix "A" attached to this by-law as Schedule "C" shall form part of this Special Condition. IS 28th DAY OF July Mo vcq) MAYOR CLERK APPENDIX A speci®I condition 11 ALBERT STREET 18.80 ZI-43 77- ------ S ITE B PARKING LOT (38 SPACES) I PROPERTY LINE LLJ Z) Z Ld 0 1777 4-65 SITE A ASSEMBLY HALL 6 4 65 -4 PROPERTY LINE SIMCOE STREET SOUTH E X P L A N A T O R Y N O T E EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 75-80 By-law Number 75-80 changes the land use designation for two parcels of land, located on the north side of Jackson Avenue , municipally known as 18 Jackson Avenue and 38 to 42 Jackson Avenue, as shown on the revised sheet Number 9 attached hereto as Schedule "A" from M-1B to R-4 subject to Special Condition 11 to permit the erection of a two-storey building containing an assembly hall, a credit union office and one apartment containing not more than two bedrooms all within one building and a parking lot with a minimum of 38 parking spaces on a separate parcel of land designed and constructed in conformity with an agreement between the City of Oshawa and the owner of the lands .
