REPORT NO.: P-144-80 SUBJECT: By-law 74-80 - City of Oshawa BACKGROUND: By-law 74-80 of the Corporation of -the City of Oshawa was for- warded to the Planning and Development Department on August 14, 1980. The By-law rezones a parcel of land in the City of Oshawa to permit commercial uses. COMMENT: The subject parcel fronts on Taunton Road East approximately 100.58 metres (330 feet) east of Simcoe Street North in the City of Oshawa, and, therefore, does not affect the interests of the Town of Newcastle. Accordingly, no action on the rezoning by-law has been taken. The date for filing objections was September 2, 1980. RECOMMENDATIONS: That the Planning and Development Committee recommend to Council: 1. That By-law 74-80 of the City of Oshawa be received for infor- mation and filed. A copy of the by-law is furnished herewith. A note giving an explanation of the purpose and effect of the by-law and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of this notice, send by registered mail or deliver to the Clerk of the City of Oshawa notice of objection to approval of the said by-law or part thereof giving details of all or the portion of the by-law to which ycm object arrd detailed reasons therefor, and shall indicate that if a bearing is held the objector or an agent will attend at the hearing to support the objection. ANY PERSON wishing to support the application for approval of the by-law may within twenty-ore (21) days after the date of this notice send by registered mail or deliver to the Clerk of the City of Oshawa notice of his support of approval of the said by-law together with a request for notice of any hearing that may be held giving the name and address to which such notice should be given. THE OiaARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a time and place when any objection to the by-law will be considered. Notice of any hearing that may be held will be given only to persons vino have filed an objection or notice of support and who have left with or delivered to the Clerk undersigned, the address to which notice of hearing is to be sent and similarly, to any person who has filed a request for a change in the provisions of the by-law. BE IT ENACTED AND IT IS HEREBY ENACTED as a by-law of The Corporation of the City of Oshawa by the Council thereof as follows: 1 . By-law Number 3415 be and the same is hereby further amended by-amending Schedule "A" thereof by adding Special Condition 60 as set out in Schedule "B" to this by-law. 2. Sheet Number 3 of Appendix "A" to By-Law Number 3415, as amended, is hereby further amended by changing the land use designation for a parcel of land, located on the north side of Taunton Road East, having approximately 58 meters of frontage and a depth of 50 meters commencing approximately 100. 58 metres east of Simcoe Street North, (shown hatched and marked with the figures "60" encircled) from R-2A to C-3 and making the lands designated C-3 subject to Special Condition "60" so that Sheet Number 3 shall be amended as shown on the revised Sheet Number 3 attached hereto as Schedule "A" . 3 . Schedules "A" and "B" attached hereto form part of this by-law. 4. No part of this by-law shall come into force without the approval of The Ontario Municipal Board but subject thereto this by-law shall take effect from the date of its passing. I SCIIL•;DULE "B" TO BY-LAW NUMBER 74-80 >--7ASSED THIS 28th DAY OF JU1 1980 A 'OR CLERK SPECIAL CONDITION 60 A parcel of land located on the north side of Taunton Road East, being approximately 100. 58 metres east of Simcoe Street North, and municipally known as 38 to 50 Taunton Road East, as shown on Schedule "A" hatched and marked C-3 with the figures "60" encircled shall be subject to the special regulations hereinafter contained and where there is any conflict between the regulations hereinafter set out and any other provisions of this by-law or By-law Number 55-73, these special regulations shall apply, but in the event that this Special Condition is silent on any matter , the provisions applicable to a C-3 use district shall apply: 1. 1 Defined Area: The area subject to this Special Condition is as shown in Schedule "A" hereto, outlined in a heavy line and hatched with the figures "60 " encircled . 1 . 2 Permitted Uses The lands subject to this Special Condition shall not be used for any purpose except as follows : (a) art gallery, (b) bank, ( c) office buildings and offices , except veterinary offices , ( d) order office or agency, ( e) personal service shop other than those listed as C-2 uses, ( f) radio or television broadcasting station or radio, ( g) restaurant, (h) retail store ( i) workshop accessory to a retail shop and located on the same lot therewith and having a floor area equal to not more than twenty (20) percent of the selling area of the rental store, ( j ) any accessory use, (k) dry cleaning and laundry pick-up depot, ( 1) dry cleaning plant which is not offensive and which uses only noncombustible cleaning solvents , (m) bakery, (n) radio repair shop, plumber' s shop or similar service shop, (o) laundry, (p) wholesale distributor . I V( PAGE; TWO OF SCHEDULE "B" 1 . 3 Prohibited Uses: Any use not specifically set out in Items (a) to (p) of Section 1 . 2 is prohibited and without limiting the generality of the foregoing, municipally prohibited uses are prohibited . 1 .4 Permitted Buildings: One building having a maximum ground floor area of 860. 83 square metres, and a maximum second floor area of 365 . 15 square metres, shall be permitted on the site. 1 . 5 Development Control: The lands subject to this Special Condition are hereby declared to be a site plan control area within the meaning . of subsection (2 ) of Section 35a of The Planning Act R. S.O. C. 349 as amended. 1 . 6 Off-Street Parking: (a) Parking requirements shall be governed by the Oshawa Off-Street Parking By-law 55-73, as amended; (b) All parking areas and driveways shall be paved with concrete or asphalt pavement and each parking space shall be clearly marked with proper pavement markings; (c) All parking areas and driveways shall not drain otherwise than into a properly installed drainage system, with proper catchbasins , connected to the nearest creek or suitable storm sewer and - the grades and drainage facilities shall be so established as to provide for drainage of any surface water including roof water, into the internal system of drainage connected to the nearest creek or suitable storm sewer. 1. 7 Loading: Off-street loading spaces shall be provided as required by the City of Oshawa Off-Street Parking By-Law 55-73, as amended . I V(9 E X P L A N A T O R Y N 0 T E EXPLANATION OF THE PURPOSE AND EFFECT OF BY-LAW NUMBER 74-80 By-law Number' 74-80 changes the land use designation for a parcel of land located on the north side of Taunton Road East having approximately 58 meters of frontage and a depth of 50 meters commencing approximately 100. 58 meters east of Simcoe Street North as shown on the revised Sheet Number 3 attached hereto as Schedule "A" from R-2A to C-3 subject to Special Condition 60 to permit the erection of a building having a maximum ground floor area of 860. 83 square meters and a maximum second floor area of 365 . 65 square meters containing commercial uses to be contructed in accordance with an agreement between the City of Oshawa and the developer of the lands.
