SUBJECT: By-law 35-80 - Township of Scugog
BACKGROUND:
By-law 35-80 of the Township of Scugog was forwarded to the
Planning and Development Department June 8, 1980. The By-law rezones
a parcel of land in the former Village of Port Perry to permit the
establishment of a service shop and one ancillary dwelling unit.
COMt[ENT:
The subject parcel of land is located on Part of Lots 237 and
238, Cameron's Plan of the former Village of Port Perry, and would not
affect the interests of the Town of Newcastle. Accordingly, no action
on the rezoning is required. The last date for filing objections is
July 25, 1980.
RECOMMENDATIONS:
That the Planning and Development Committee recommend to Council:
1. That By-law 35-80 of the Township of Scugog be received and
filed.

BEING A BY-LAW TO AMEND RESTRICTED AREA
BY-LAW NUMBER 29-74 .
WHEREAS the Council of the Corporation of the Township
of Scugog has ,received a request to amend Restricted Area By-Law

No. 29-74, being the comprehensive zoning by-law of the former
Village of Port Perry, insofar as is necessary to permit the
redevelopment and use of part of Lots 237 and 238, Cameron 's Plai
for the purposes of establishing a service shop for small engine
repairs and an ancillary residential dwelling.
AND WHEREAS the Council of the Corporation of the
(' Township of Scugog has reviewed the request in the context of th
Official Plan of the Regional Municipality of Durham and the
Official Plan of the former Village of Port Perry and considers
it advisable to amend Restricted Area By-law No . 29-74 sD as to
C permit the redevelopment and use of the said property for the
purpose of establishing a service shop for the repair of small
engines and an ancillary residential dwelling, in accordance wit]
the provisions of the General Commercial (CS) Zone as set forth
under By-law No. 29-74;

AND WHEREAS the matters herein set forth are in
conformity with the provisions of the approved Official Plan of
the former Port Perry Planning Area;
AND WHEREAS there has been no amendment to the approve
Official Plan of the former Port Perry Planning Area with which
f the matters herein set forth are in contravention;
AND WHEREAS the matters herein set forth are further
considered to be in conformity with the provisions of the Offici
Plan of the Regional Municipality of Durham;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SCUGOG Enacts As Follows :
1 .. That Schedule "A", the Zone Map, attached to and forming par
of Restricted Area By-Law No. 29-74 , be and the same, is
hereby amended insofar as is necessary to rezone those lands
forming part of Lots 237 and 238, Cameron ' s Plan, as
delineated on the Zone Map, attached hereto as Schedule "A"
and forming part of this By-Law, from the Deferred Commercia
(C6) Zone to the General Commercial Exception No. 114
(C5-114) Zone.

NOTICE OF APPLICATION to The Ontario Municipal Board
by The Corporation of the Township of Scugog for
approval of a by-law to regulate land use passed
pursuant to Section 35 of The Planning Act.
TAKE NOTICE that the Council of the Corporation of the Township of Scugog
intends to apply to The Ontario Municipal Board pursuant to the provisions
of Section 35 of The Planning Act for approval of By-Law #35-80 passed
on the 23rd day. of June 1980• A copy of the by-law is furnished
herewith "and a note giving an explanition.of the .purpose and effect.of the
by-law and stating the lands affected thereby is also furnished herewith.
ANY PERSON INTERESTED MAY, within twenty-one (21) days after the date of
this notice, send by registered mail or deliver to the clerk of the Town-
ship of Scugog notice of objection to approval of the said by-law or part
thereof giving details of all or the.portion of the by-lax to which you
object and detailed reasons therefor, and shall indicate that .if a hear-
ing is held the objector or an agent will attend at the hearing to support
the objection.
ANY PERSON wishing to support the application for approval of the by-law
'may withiin-twenty-one (21) days after the- date of this notice send by.
registered mail or deliver to the clerk of the Township of Scugog'notice
of his support of approval of the said by-law together with a request
for notice of any hearing that Auay be held giving also the name and
address to which such notice -should be given.
TUB ONTARIO MUNICIPAL BOARD may approve of the said by-law but before
doing so it may appoint a time and place when any objection to the by-
'law will be considered. Notice of any hearing that may be held will be
. given only to persons who have filed an objection or notice of support
and
who have left with or delivered to the clerk. undersigned, the address
to which notice of hearing is to be sent and, similarly, to any person
who has filed a request for a change in the provisions of the by-law.
THE LAST DATE FOR FILTNG OBJECTIONS will be July 25th 1980

29-74 , as amended, is hereby further amended insofar as is
necessary to insert a new subsection which shall read as
follows :
