REPORT NO. : P-129-80 SUBJECT: By-law 1652-80 - Township of Manvers BACKGROUND: By-law 1652-80 of the Township of Manvers was forwarded to the Planning and Development Department July 4, 1980. The By-law rezones a parcel of land in the Township of Manvers from Rural Area (RA) to Extractive Industrial (EID) Zone to permit the establishment of a pit and quarry. COMMENT The subject parcel is located in Part of Lot 1, all of Lot 2, and Part of Lots 3 and 4, Concession 2, in the Township of Manvers, and would not affect the interests of the Town of Newcastle. Accordingly, no action on the rezoning by-law is required. The last date for filing objections is July 23, 1980. RECOMMENDATION: That the Planning and Development Committee recommends to Council: 1. July 15, 1980 Director of Planning THE PLANNING ACT NOTICE OF THE PASSING OF A BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF MANNERS ;;;jLN1 TO REGULATE LAND USE PURSUANT TO 'S'F SECTION 35 OF THE PLANNING ACT Y TAKE NOTICE that the Council of The Corporation of the Township of Manvers has passed By-Law 1652-80 on the 10th day of June, , 1980 pursuant to the provisions of Section 35 of The Planning Act. The following Schedules are attached hereto: 1. Schedule 1, being a copy of By-Law 1652-80. . 2. Schedule 2, consisting of the following: i. An explanation of the purpose and effect of the By-law. ii. A key map which shows the location of the lands to which the By-law applies. 3. Schedule 3 is not applicable here. 4. Schedule 4, being a statement of the Chief Planning Officer of the County in which the land to which the By-law applies is situate. ANY PERSON INTERESTED MAY, within twenty-one days after the date of the mailing, personal service or publication of this notice, file with the Clerk of the Township of Manvers notice of an objection to the approval of the said By-law or part thereof together with details of all or that portion of the By-law to which there is objection and detailed reasons thereof. ANY PERSON wishing to support the application for approval of the By-law may, within twenty-one days after the date of the mailing, personal service or publication of this notice, file with the Clerk of the Township of Manvers notice of support of the application for approval of the said By-law. If no notice of objection has been filed with the Clerk of the Municipality within the time provided, the By-law thereupon comes into effect and does not require the approval of the Ontario Municipal Board. If a notice of objection has been filed with the Clerk of the Municipality within the time provided, the By-law shall be submitted to the Ontario Municipal Board and the By-law does not come into effect until approved by the Ontario Municipal Board. By-Law 1652-80 has the following purpose and effect: By-Law 1652-80 rezones part of Lot 1, all of Lot 2 and parts of Lots 3 and 4, Concession II in the Township of Manvers from Rural Area (RA) Zone to Extractive Industrial (EID) Zone. The land to be rezoned is shown on Schedule "A" of the attached By-Law. This amendment will permit the establishment of a pit and quarry, the processing of natural materials (including screening, sorting, washing and crushing operations) and agricultural uses. The zone uses and requirements are detailed in By-Law 1515-72 as amended, the Zoning By-Law covering the entire Township. 2. A Key Map and Schedule "A" of By-Law 1652-80 are one and the same. SCHEDULE NO. 114" STATEMENT OF CONFORMITY TO THE OFFICIAL PLAN FOR THE VICTORIA COUNTY PLANNING AREA I , Robert Griffiths , the Chief Planning Officer of the Corporation of the County of Victoria have reviewed By-Law 1652-80 of the Corporation of the Township of Manvers. I am of the opinion that the By-Law is in conformity with the Official Plan in effect for the Victoria County Planning Area. Chief Planning Officer. I I # WHEREAS the Council of the Township of Manvers has received an application I� to rezone part of lot 1, Concession II , all of Lot 2, Concession II and 1 ipart of Lots 3 and 4, Concession II in the Township of hlanvers, an area of approximately 537 acres from Rural Area (RA) Zone to Extractive Industrial (EID) Zone so as to establish a Pit and Quarry operation. AND WHEREAS, the Council of the Township of Manvers has reviewed By-Law 1515-72 as amended and the application for rezoning and deems it advisable to amend the Comprehensive Zoning By-Law. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF MANVERS ENACTS THE FOLLOWING BY-LAW. 1. THAT, Schedule "A" of the Township of Manvers By-Law 1515-72 as amended be further amended insofar as to change the zoning from Rural Area (RA) Zone to Extractive Industrial (EID) Zone on the i land referred to as "land to be zoned EID" as shown on Schedule "A" j I� attached hereto and forming a part of this By-Law. i 2.
