REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF JULY 21, 1980.

SUBJECT: Application for Rezoning Number Z-A-3-4-2
Part of Lot 10, Concession 6, Village of Kendal
formerly Township of Clarke - Mrs. M. Garbutt
BACKGROUND:
On June 9, 1980, Report P-94-80 was presented to the Planning
and Development Committee regarding the rezoning of a 5774.8 square
metre (1.427 acre) parcel of land fronting on Mill Street in the
Village of Kendal for residential purposes. At the Council meeting
on June 16, 1980, the following resolution was adopted by Council:
"That application for Rezoning Number Z-A-3-4-2, part Lot
10, Conc. 6, Kendal, be approved upon the applicant fulfilling
the financial requirements of the Regional Municipality of
Durham and the Town of Newcastle."
COMMENTS:
Planning staff have been advised that the applicant has fulfilled
the requirements of the Regional Municipality of Durham and the Town of
Newcastle. Therefore, in order to complete the rezoning process, the
attached by-law amendment must be forwarded to Council for approval.

RECOMMENDATION:
It is respectfully recommended:
1. That the attached By-law 80- ''/pertaining to application
for rezoning Z-A-3-4-2 be forwarded to Council for approval.

By-law Number 80- 99
A By-law to amend Restricted Area By-law
Number 1592, as amended, of the former Township
of .Clarke.
WHEREAS the Council of the Corporation of the Town of Newcastle
DEEMS it advisable to amend Restricted Area By-law Number 1592, as
amended, of the former Township of Clarke.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1. Schedule "A" to By-law 1592, as amended, is hereby further amended
by changing to RR the zone designation of the lands indicated as
"ZONE CHANGE TO RR" on the attached Schedule "X" hereto.
2. This By-law shall come into effect on the date hereof, subject
to the provisions of Section 35(10) of the Planning Act.
BY-LAW READ a first time this day of , A.D. 1980.
BY-LAW READ a second time this day of A.D. 1930.
BY-LAW READ a third time and finally passed this day of
A.D. 1980.
