REPORT NO. : P-124-80 SUBJECT: By-law 43-80 - Township of Scugog BACKGROUND: By-law 43-80 of the Township of Scugog was forwarded to the Planning and Development Department on June 10, 1980. The By-law rezones a parcel of land in the former Township of Scugog to permit the development of a thirteen lot draft approved residential subdivision. COMMENT: The subject parcel is located within the Hamlet of Utica, part of Lot 6, Concession 5, of the former Township of Scugog and does not affect the interests of the Town of Newcastle. Accordingly, no action on the rezoning by-law was required. The date for filing objections was June 30, 1980. RECOMMENDATION: That the Planning and Development Committee recommend to Council: 1. July 4, 1980 Director of Planning EXPLANATORY NOTE PURPOSE OF THE RESTRICTED AREA BV-LA(V: In accordance with the provisions of Section 35 of The Planning Act, R.S.O. 1970, c. 349, as amended, the Council of the Corporation of the Township of Scugog has enacted the attached comprehensive Restricted Area By-law. The By-law serves to restrict the use of lands, and, to control and regulate the character, location and use of those buildings and structures to be developed within the context of a .plan of subdivision which has received draft plan approval from the Minister of Housing. The plan of subdivision is located within the Hamlet of Utica, adjacent existing development. JM` LOCATION OF The lands affected by this Restricted Area By-law are located' in LANDS AFFECTED: part of Lot §, Concession 5, Ward One of the Township of Scugog. The site is to the north of Regional Road No. 21 and west of the Township road allowance between L,ots6 and 7, Concession 5. For specific delineation of the site in question reference should be made to Schedule "A" , the Zone Map attached to and forming part of the Restricted Area By-law. EFFECT OF The effect of the attached By-law is described as follows, THE 8V-LAW: i . to provide for the development of thirteen lots for the purposes of detached single-family dwelling houses; ii . to retain those lands- adjacent the creek along the northerly property boundary in their natural state by prohibiting the erection of permanent buildings or structures thereon; To this end, the Restricted Area By-law zones the subject lands within two specific zone categories, namely, the Hamlet Residential (HR) Zone and the Environmental Protection (EP) Zone. The By-law sets forth numerous standards and regulations related to such matters as lot area and frontage requirements, lot coverage, height' of buildings, yards, setbacks, etc. , for the uses permitted within the respective zones, and, in this manner, is considered to effect a desirable and reasonable level of control over future developmen+ __ by the Municipality. -2-- EFFECT OF As previously noted the lands affected by this By-law are the THE 8y-LAW: subject of a plan of subdivision which received draft plan approval from the Minister of Housing on November 22, 1979, (M.O.H. File No. 18T-78073. ) In granting draft plan approval the Minister imposed various conditions .which must be complied with before registration of the subdivision. Condition No. 5 requires that, prior to signing of the final plan by the Minister, the lands are to be appropriately zoned within a Restricted Area By-law'whi.ch has been approved by the Ontario Municipal Board. Therefore, upon approval of the attached By-law by the Ontario . Municipal Board, Condition No. 5 will have been complied with.
