SUBJECT: Requested Amendment to Sign By-law - Canadian
Imperial Bank of Commerce - Newcastle Village

BACKGROUND:
The attached letter from Mr. Gallienne of the Canadian Imperial
Bank of Commerce, which was considered by Council at its Meeting of
June 2, 1980 has been referred to the Planning and Development Committee.
This letter requests an amendment to the Town of Newcastle Sign By-law
to permit the erection of an additional sign, containing the Bank's logo,
on the new Bank of Commerce building in the former Village of Newcastle.
At present, the Sign By-law permits the erection of one sign with a
total sign area, not to exceed 80 square feet or .1% of the lot area, for
each professional or business establishment on a lot in a commercial zone,
and permits an additional sign only in cases where the lot fronts on more
than one street. Since the Bank of Commerce is on an interior lot, lthe
Sign By-law would restrict to one the number of signs permitted on the
lot. At present, the definition of a "sign" includes any symbol or device
which is used to identify or advertise an organization; and, therefore,
the placement of the Bank's logo on the building would offend the provisions
of the Sign By-law.

COMENT:
Planning staff has reviewed the Bank's request with the Chief
Building Official, and have no objection to the approval of the appli-
cant's request, inasmuch as the logo is innocuous and relatively small
and would not disrupt the visual amenity of King Street. However, it
is suggested that instead of a general amendment to the By-law to per-
mit additional signs in all commercial zones, it would be more appropriate
to introduce a special provision to the By-law to permit the location of
a corporate logo on the bank property.
RECOMAENDATION:
It is respectfully recommended:
1. That this report be received for information; and
2. That the attached By-law 80- be forwarded to Council
for approval.

Steel Art Company Limited working on behalf of the Bank made application for
signage on our new building at the above location during the new year. On
February S, 1980, your Chief Building Official advised this Company of your
current bylaw 76-25 making reference to Section 8(2) (a) (iii) and 8(2) (b) (vi) ,
essentially limiting the placement of signage to one elevation and limiting
its size to a percentage of the area of the wall on which it is mounted. In
compliance with your Sign bylaw, we made reductions in the number of signs
from our original proposal and installed only a sign on our King Street elevation.
Since this sign has been installed it has become apparent that there will be
little opportunity for motorists travelling west on King Street to recognize the
presence of our Bank. Ile therefore request a variance on our behalf from Section
8(2) (a) (iii) which would allow the Bank to erect a 216" high corporate logo on
the east elevation close to the front of our new premises.

THE CORPORATION OF THE

By-law Number 80-
A By-law to amend By-law Number 76-25, as amended,
of the Corporation of the Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it advisable to amend By-law 76-25, as amended, of the Town of Newcastle.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1. By-law 76-25, as amended, of the Corporation of the Town of New-
castle is hereby further amended by renumbering Section 11 thereto
as Section 12.
2. By-law 76-25, as amended, of the Corporation of the Town of Newcastle
is hereby further amended by adding thereto the following Section 11:
"SECTION 11 SPECIAL CONDITIONS
The following is a list of the special provisions which shall apply
to the lands included within the "Defined Areas" of each "SPECIAL
CONDITION". In the event that there is any conflict between the
provisions of any "SPECIAL CONDITION" and any other provision of this
By-law, then the provisions of the subject "SPECIAL CONDITION" shall
apply, but in the event that such "SPECIAL CONDITION" is silent on
any matter, then the provisions of this By-law shall apply.
SPECIAL CONDITION 1
1.1 Defined Area
The lands subject to this SPECIAL CONDITION comprise Lot 1,
Part of Lot 2, and part of the Unnumbered Lot, Block A, C. G.
Hanning's Plan for the Village of Newcastle.

1.2 Permitted Signs
In addition, to the signs permitted by Section 8 of this
By-law, a wall sign bearing the corporate logo of the
financial institution in the "Defined Area" shall be per-
mitted, provided that the sign area of such wall sign shall
not exceed ten square feet."
3. This By-law shall become effective on the date of final passing
hereof.
