SUBJECT: Committee of Adjustment Procedures
Committee Resolution #PD-216-80
regarding Mr. N. Allin delegaton to June 9, 1980
Planning and Development Committee
BACKGROUND:
At the June 9, 1980 Planning and Development Committee meeting
Mr. N. Allin appeared in respect of the Newcastle Committee of Adjust-
ment's procedures. After considering Mr. Allin's comments, the Committee
adopted the above captioned resolution: #PD-216-80 - "That Mr. Allin's
delegation be acknowledged and he be advised that the Director of Plan-
ning will be conveying his comments to the next meeting of the Committee
of Adjustment."
COMMENT:
The Director of Planning attended the Committee of Adjustment meeting
of June 25, 1980 and briefly outlined Mr. Allin's concerns to the Committee.
The Committee was reminded that it is required to hold a hearing on any
appropriately filed application and that there is no limitation on an appli-
cant as to the number of times that he/she may apply to the Committee for
consideration of the same matter. The Committee was reminded that it is
required to give reasons for its decisions on approval or denial of an
application.

It was noted that in the case of a tie vote that an application
is "not granted" as opposed to "denied" or "approved".
It appeared to the Director of Planning that the Committee had
a good working knowledge of the requirements set out under Section 42
of the Planning Act and the applicable government regulations.
RE,COMENDATION:
It is recommended:
"That the Planning and Development Committee receive this report
for information."
