REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF June 23, 1980.
REPORT NO. : P-110-80
SUBJECT: Ontario Municipal Board Hearing of an Appeal by
Joan A. Honeyman against the decision of the Region
of Durham Land Division Committee in respect of appli-
cation for severance No. LD 434/79
BACKGROUND:
On January 14, 1980, the Region of Durham Land Division
Committee approved an application requesting the severance of <-, lot
with a frontage of 15.24 metres and an area of 418 square metres from
a 898 square metre lot on Liberty Street North in Bm,,-manville. The
approval granted by the Committee was subject to the fulfillment of the
following conditions:
"l. That the applicant satisfy the requirements of the
Town of Newcastle, financial and otherwise;
2. That the applicant satisfy the requirements of the
Regional Municipality of Durham, financial and other-
wise;
3. That the applicant submit two copies of a registered
reference plan for the clearance of documents;
4. That this approval shall lapse at the expiration of
two years from the date the decision is final and
binding unless all the conditions are fulfilled and
the formal consent has been released;

5. That prior to the signing of the certificate given
by the Secretary/Treasurer that the consent has been
given, the Secretary/Treasurer is to be advised in
writing by the Town of Newcastle that Condition #1
has been carried out to their satisfaction;
6 . That prior to the signing of the certificate given
by the Secretary/Treasurer that the consent has been
given, the Secretary/Treasurer is to be advised in
writing by the Regional Municipality of Durham Works
Department that Condition 1�2 has been carried out to
their satisfaction."
The applicant has appealed the conditions imposed by this
decision to the Ontario Municipal Board; and the appeal will be heard
by the Hoard on July 4, 1980.
COMMENTS:
Since one of the conditions applied to the approval of this
severance was the payment of a lot development charge of $1500 to the
Town in respect of the "subject" lands, ill accorc(rince with the provisions
of By-law 79-151, it would be appropriate for Plannin; staff and the Town
Solicitor to attend the hearing in support of the Land Division Committee's
decision.
RE COM1AENDATION:
It is respectfully recommended:
1. That this report be received for information; and
2» That Planning staff and the Town Solicitor be authorized
to attend the subject Ontario Municipal Board Hearing in
support of the decision of the Land Division Committee and/or
to resolve the matter with the applicant prior to the hearing.
