P-76-80 SUBJECT: Application for Rezoning Number A-3-9-2 Part Lot 28, Concession 5, Village of Orono, former To-unship of Clare - Lora May McLaren (Map attached) BAC:GROUND: The subject application: requests an amendment to the Clarice Zoning By-late- to rezone a 214 square metre 1'2303 square feet) parcel of land fronting on Station Street in the Village of Orono. The aoDlicat-on was circulated to the Durham Planning and Wor1:s Departments, the Durham Health Unit, Orono Public tit .lines Co?m2ss-3ft, NeWCastle and Building Departments, and tl.?e Loii'- -Range Pla:xar for the Town of Newcastle for coFduea t. The Durham Planning and Works DeLartmants submitted the following comments'. "The subject site is located in Orono, a designated "Hamlet" in the Durham Regional Official Plan. Development is limited to minor internal infilling andifor minor additions to existing development. The proposed razoning which would facilitate the creation of two additicon! residential lots appears to conform. With respect to the prevision of Regional Services, municipal water supply is available to the frontage of the subject land abutting Station Street. There are no sanitary sewer services in Orono.'' The Orono Public Utilities Commission submitted the following: "The Commission did not object to the closing of these streets as long as an easement was given where Hydro Utilities existed. At poesent, a Hydro line is located on the unnamed street be- tween Cobbledick Street and the rear property live of the M20- cal Centre or the extension of Victoria Street. The Commission also felt that this rezoning might help to straighten out the street line on Station Street which has been a source of controversy for a number of years". Tho Ncwcastle Works Department stated the following: "Q! There are no objections to the proposed rezoning, from industrial to residential use. (b) it has already bean agreed that the road allowances - Victoria Street and the unnamed street - will be closed by by-law and conveyed to the abutting owners. This is in lieu of land conveyed to the Town for proper ownership of Station Street. There is unccrtainsy as to whether the Plan, as presenned, is correct. Upon the closure and conveyance of Victoria Street, the Act requires that it be apportioned, and offered equally, to each abutting owner. Should the owner to nha south of Victoria Street wish to exercise his option to pur- chase his share, then the Plan, as shown, would be incorrect".
