SUBJECT: By-law 15-80 - Township of Scugog
BACKGROUND:
By-law 15-80 of the Township of Scugog was forwarded to the
Planning and Development Department April 3, 1980. The By-law rezones
a parcel of land in the Township of Scugog to permit the development
of 86 residential lots and 19 industrial lots.
COMMENT:
The subject parcel is located in part of Lot 18, Concession 7,
of the Township of Scugog and does not affect the interests of the Town
of Newcastle. Accordingly, no action on the rezoning by-law has been
taken. The date for filing objections is April 22, 1980.
RECOMMENDATION:
That the Planning and Development Committee recommend to Council:
1. That By-law 15-80 of the Township of Scugog be received
and filed.

TO REGULATE LAND USE PASSED PURSUANT TO SECTION 35
OF THE PLANNING ACT.

TAKE NOTICE that the Council of the Corporation of the Township of Scugog intends to
apply to The Ontario Municipal Board pursuant to the provisions of Section 35 of The
Planning Act for approval of By-law No. passed on the . . . .. day of

ANY PERSON INTERESTED MAYP, within twenty-one (21 ) days after the date of this no ce
send by registered mail or deliver to the Clerk of the Township of Sc.ug.og notice ol,
objection to approval of the said By-law or part thereof, giving details of all or
the portion of the By-law to Which you object and detailed reasons therefor, and
shall Indicate that If a heari.ng is held the objector or an agent will attend at the
hearing to support the objection.
ANY PERSON wishing to support the application for approval of the By-law may wi-d,ln
twenty-one (21 ) days after the date of this notice send by registered mail or deliver
to the Clerk of the Township of Scugog notice of his support or approval of the !',1id
By-law together with a request for notice 'of any hearing that may be held giving
also the name and address to which such notice should be given.
THE ONTARIO MUNICIPAL BOARD may approve of the said By-law but before doing so it.
may appoint a time and place when any objection to the By-law will be considered.
Notice of any hearing that may be held will be given only to persons who have filed
an objection or notice of support and who have left with or delivered to the Clerk
undersigned, the address to which notice of hearing is to be sent and, similarly, to
any person who has filed a request for a change in the provisions of the By-law.

EXPLANATORY NOTE
Purpose of 'the
Restricted Area
By--law: In accordance with the provisions of Section 35 of
The Planning Act, R.S.O. 1970, c. 349, as amended,
the Council of the Corporation of the Township of
Scugog has enacted the attached comprehensive
Restricted Area By-law. The By- law serves to restrict
the use of those lands, and, to control and regulate
the character, location and the use of those buildings
and structures to be developed within the context of
a plan of subdivision which has received draft plan
approval from the Minister of Housing.
Location of,
Lands .Affected: The lands affected by this By-law are located in part
of Lot 18, Concession 7, of Ward One of the Township
Of Scugog. The site is generally described as being
bounded by the road allowance between Concession 7 and
8 to the north, Regional Road No, 2 to the east,
Regional Road No. 8 to the south and Simcoe Street to
the west. The lands affected by -the Restricted Area
By-law are delineated in greater detail on the zone Map
attached to and forming part of the zoning By-law.
Effect of the
Restricted Area
By-law: In summary the effect of this By-law is described as
follows, namely:
i to provide for the development of 86 lots for
single-family residential purposes;
ii to provide for the development of 19 lots for
industrial purposes; and

iii to retain the flood susceptible area adjacent
Cawker's Creek in its natural state and provide
for the development and use of such lands for
park purposes or as private open space.
In- this regard the By-law zones the subject lands '
0
within various classifications, namely an Environmental
Protection (EP) Zone, a Private Open Space (OS-P) Zone,
a Single-Family Residential (R1-1 ) Zone and a Restricted
Industrial (141 ) Zone. The By-law further serves to
establish numerous provisions which regulate the
use and development of the lands within each zone
classification.
As previously noted the lands affected by this By-law
are the subject of a plan of subdivision which received
draft plan approval from the Minister of Housing on July
24, 1978. (M.O.H. File No. 18T-77125) In granting draft
plan approval the Minister imposed various conditions
which must be complied with before registration of the
subdivision. Condition Pao. 6 requires that, prior to
signing of the final plan by the Minister, the lands are
to be appropriately zoned within a Restricted Area By-law
which has been approved by the Ontario Municipal Board.
Therefore, upon approval of the attached By-law by the
Ontario Municipal Board, Condition No. 6 will have been
complied with.
