REPORT NO. : P-62-80 r SUBJECT: Land Division Committee Application Number LD 77/80 Part of Lot 21, Concession 3, former Township of Darlington - Fenia and John Samochin BACKGROUND: Two applications for severance were submitted by the applicants in respect of a 49 hectare parcel of land situated in Lot 21, Conces- sion 3 in the former Township of Darlington. Application Number LD 77/80 requested the severance of Part 1 on the attached Plan from Parts 2 and 3. The application indicated that Part 1 was to be conveyed for agricultural purposes and that parts 2 and 3 were to be retained by the applicant. Application Number LD 76/80 requested the severance of Part 2 from Part 3, and indicated that Part 2 was to be conveyed to Ontario Hydro for use as a Hydro Transmission Corridor, while Part 3, containing a house and farm buildings, was to be retained by the applicant. Both applications were approved by the Land Division Committee on February 25, 1980. i I 2 - COMMENTS: The lands described as Part 1 on the attached Plan comprise approximately 4.45 hectares. However, road access to the useable portion of the site would only be possible over a 1007 metre drive- way from the Diversion Road, or by way of a 12 metre easement across Part 2. Staff note that the Land Division Committee has imposed, as a con- dition of severance, a . 3 metre reserve across the frontage of Part 1. However, in light of the fact that Part 1 is surrounded by agricultural lands to the west and south, and will be separated from other lands owned by the applicant by Part 2, it is the opinion of staff that Part 1 should not be a separate lot; but rather should meld with Part 2 or with any of the abutting agricultural lands. RECOMMENDATION: It is respectfully recommended: 1. That staff be authorized to appeal the decision of the Land Division Committee in respect of Application Number LD 77/80 to the Ontario Municipal Board. Respectfully submitted, NJF:lb D. Id.
