REPORT NO. : P-40-80 I i SUBJECT: By-law 154-79 - City of Oshawa BACKGROUND: By-law 154-79 of the Corporation of the City of Oshawa was forwarded to the Planning and Development Department February 21, 1980. The By-law rezones a parcel of land in the City of Oshawa as Special Condition 92 to permit specific industrial uses. COMMENT: The subject parcel is located on Phillip Murray Avenue, bounded on the west by Stevenson Road South and on the east by Park Road South. As a result of its location, the subject rezoning does not affect the interests of the Town of Newcastle. Accordingly, no action on the rezoning by-law is necessary. The last date for filing objections is March 10, 1980. RECOMMENDATION: That the Planning and Development Committee recommend to Council: 1. February 26, 10 Director of Planning T NOTICE OF APPLICATION TO THE ONTARIO MUNICIPAL BOARD BY THE 'C CORPORATION OF T11E CITY OF OSfU\WA FOR APPROVAL OF A BY-LAW TO REGULATE LAND USE PASSED PURSUANT TO SECTION 35 OF THE PLANNING ACT TAKE, NOTICE that the Council of The Corporation of the City of Oshawa intends- to apply to The Ontario Municipal Roan.1 pursuant to the provisions of Section 35 of The Planning Act for a[I)roval of By-law Narber 154-79 passed on the 17th day of December 1979 . A copy of the by-law is furnished herewith. A note giving an explanation of the purpose and effect of the by-law and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY within twenty-one (21) days after the date of t-Iiis notice, send by registered mil or deliver to the Clerk of the City of Oshawa notice of objection to approval of the said by-law or part thereof yiviny details of all or the portion of the by-law to which you object and detailed reasons therefor, and shall indicate that if a hearing is held the objector or an agent will attend at the hearing to support the objection. ANY PERSON wishing to support the application for approval of the by-law n-ay within twenty-one (21) days after the date of this not-ice send by registered mil or deliver to the Clerk of the City of Oshawa not-ice of his support of approval of the said by-law together with a request for notice of any hearing that m-y be held giving also the name and address to which such notice should be given. T11L ONTARIO MUNICIPAL BOARD may approve of the said by-law but before doing so it may appoint a tire and place when any objection to the by-law will be considered. Not-ice of any hearing that may be held will be given only to persons who have filed an objection or not-ice of support and who have left with or delivered to the Clerk undersigned, the address to which notice of hearing is to be sent and similarly, to any person who has filed a request for a change in the provisions of the by-law. The lands shown as Parts 2 and 4 on Appendix "A" to Special Condition 92 have been designated to permit uses such as offices , research facilities , and warehousing which are limited in scope by the reculations and will therefore have a substantially reduced impact on existing and proposed residential areas to the south and east . The 1,3n:3s designated as Part 3 on Appendix "A" to Special Condition 92 permit a somewhat ,nore intense industrial use. The chan�3es in designation of the lands which are changed from F to M-IA arises from a difficulty in interpreting the exact limit �f the lands designated MI-A by by-law 3415 as originally enacted .
