SUBJECT: Application for Rezoning Number Z-A-2-4-8
King Street, Bowmanville - James Chow
BACKGROUND:
An application has been submitted requesting an amendment
to the Restricted Area (Zoning) By-law of the former Town of Bowman-
ville to permit the development of an 1800 square foot take-out rest-
aurant on a 1.69 acre parcel situated at the south-west corner of King
Street and Queen Street in Bowmanville.
The proposal was circulated to the appropriate commenting
agencies, in accordance with adopted procedures, and two main areas of
concern were identified as a result of this process.
Both the Central Lake Ontario Conservation Authority and the
Newcastle Building Department have expressed concern about the fact
that a considerable amount of fill has been placed on the subject lot
in the past, and have requested detailed soils investigation prior to
the approval of any development on the site.
The major constraint to the development of the site is summarized
in the comments submitted by the Durham Works and Planning Departments:

"With respect to Regional services, be advised that there
are existing watermains and sanitary sewers abutting the
Queen Street frontage of the subject property. However,
the existing sanitary sewers on Queen Street are operating
under surcharge and the necessary capacity is not avail-
able to the subject proposal until the Bowmanville Creek
diversion is constructed to alleviate the present surcharge
condition. Said diversion sewer is scheduled for construction
in 1984. Therefore, any proposed development on this site
is premature at the present time due to servicing constraints."
COMMENTS:
Because the site would not be connected to the municipal sewage
system for at least four years, and because changing market conditions
could significantly alter the form of the proposed development, staff
agrees with the Region's position that the proposed development is pre-
mature, and submits that further consideration of the proposal is not
warranted at this time, pending satisfactory resolution of the servicing
problem. It is also noted that Section 8.2.3.2 of the Durham Official
Plan stipulates that "Central Areas shall be fully serviced by municipal
water and sewage systems, and that this shall be a necessary condition
before development in Central Areas is permitted."
At such time as sanitary sewer services are available to the site,
the applicant should be encouraged to commission the required engineering
report and resubmit an application for rezoning for the site.
RECOMMENDATION:
It is respectfully recommended:
1. That this report be received for information;
2. That Application for Rezoning Number Z-A-2-4-8 be denied;
and
3 -
3. That the Regional Municipality of Durham be advised
of the actions of the Town of Newcastle in this
regard.
