(416)263.2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING Or MARCH 3, 1980 REPORT NO: P-34-80 SUBJECT: Correspondence from Mr. S. Mastrangelo Regarding Severance Part of Lot 25, Concession 3, (Darlington) . BACKGROUND: As indicated in the above mentioned correspondence, copies attached, Mr. Mastrangelo made an application to the Regional Land Division Committee to sever a 4,181 m2 parcel including an existing home and garage from his existing lot on Solina Road. The Land Division Committee considered his application on June 11, 1979 and denied his request. Mr. Mastrangelo appealed the Committee's decision to the Ontario Municipal Board. Staff note that the Ontario Municipal Board denied the application on the basis of Section 10.2.1.4 of the Durham Regional Official Plan. That section defines "infilling" and would allow severances if a node or cluster of non-farm residential dwellings is identified in the respective zoning by-laws. At the present time, the Clarke and Darlington Zoning By-laws do not identify nodes or clusters as outlined in Section 10.2.1.4 of the Durham Regional Official Plan. It is staffs intention to define and if possible clarify "nodes and clusters" in Part I of the District Plan for the Town of Newcastle (now in preparation), which will ultimately allow for the recognition of nodes and clusters in the Zoning ;, ��}) 2 - By-laws. If this area is defined as a non-farm residential cluster further consideration could be given to Mr. Mastrangelo's request. The Board heard Mr. Mastrangelo's appeal on January, 18, 1980 and concerned with the decision of the Land Division Committee. A copy of the Board's decision was forwarded to the Town on January 22, 1980 and received for information by Council at the Council Meeting of January 28, 1980. COMMENTS: In addition to the attached correspondence, staff received • letter from Mr. Mastrangelo on February 12, 1980, which in • copy of correspondence forwarded to Town Council (dated February 11, 1980) . A copy of staff's reply dated February 14, 1980, already circulated to members of Council, is attached for information. Staff note that decisions of the Ontario Municipal Board may be appealed to Cabinet. RECOMMENDATIONS: THAT Planning and Development Committee recommend to Council that a copy of this report be forwarded to Mr. Mastrangelo for his information. Respectfully Submitted, 1 � r,f D.N. R. 4 Bowmanville, Ontario Dear Sir: Please be advised that I reside on part of lot 25, Concession 3 in Town of Newcastle formerly in the Township of Darlington. it was - my intention to divide part of the lands and give some to my father and keep the rest so I could build my family a new house on* a separate piece of land. I went to Land Division Committee for separation and though the Town of Newcastle supported me, the Region didn't, so the Committee' did not give me permission. With this letter I have put a copy of the letter from the Town of Newcastle supporting me, and a copy of a survey of the land so that you can understand my position better. . I would like now to keep the old house, in which my father will live, and build a new house on all the lands, two houses on one piece of land. I understand that this can be done if the Town of Newcastle gives me permission. I kindly ask that you support my position and would be happy to meet and talk to you to explain my position better.
