(416)263-2231 REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE 14EETING OF MARCH 3, 1980 REPORT NO: P-33-80 SUBJECT: Status of Airstrip Part of Lot 31 and 32, Concession 1 Former Township of Darlington (Key Map) (C. Gabourie) BACKGROUND: The attached letter from Mr. D. Wesson, Whattam Realty Inc. , has been referred to the Planning and Development Department for a report to the Planning and Development Committee. Mr. Wesson is inquiring as to the status of the airstrip, Councils intentions in respect of the use of the property and the possibility of having the property rezoned for residential uses. Planning Staff reported to the Planning and Development Committee in respect of this matter in December of 1978. A copy of Report P-108-78 is attached. The Planning and Development Committee again considered Staff Report P-108-78 on February 1st, 1979, at which time the following Resolution was adopted:- "THAT Report P-108-78 - Gabourie Airstrip, be received and filed and removed from the Agenda." COMMENTS: Planning Staff have contacted the Airways Branch of the Federal Ministry of Transport and have been advised that the private aerodrome licence issued on December 27, 1970, as referred to in Staff Report P-108-78, has expired. Staff have been further advised that a private 2/ t f> - 2 - Report P-33-80 airstrip does not require a licence provided that no commercial use of the strip is undertaken by the owner. A private airstrip for the use of a farmer, for instance, would not require a licence provided that no service is offered to the public. Under the current "Agriculture" zoning a private airstrip may be interpreted as a permitted use, provided that it is accessory to the agriculture use of a property. (Refer to Staff Report P-108-78) In light of the above, only a private airstrip may be permitted on the Gabourie property provided it is accessory to an agricultural use of the property. Staff suggest that this matter be referred to the By-Law Enforcement Officer for investigation and possible action in respect to a possible by-law infraction. Staff note that the airstrip licence issued in 1970 does not pre-date the approval of the Darlington Restricted Area Zoning By-Law (1959) . It is, therefore, doubtful that the airstrip could be interpreted as a legal non-conforming use. In respect of Mr. Wesson's inquiry as to the possibility of rezoning the property for residential uses, staff note that the lands are designated as "General Agricultural" in the Regional Official Plan. The "General Agricultural" area classification means that the predominant use of lands in areas so designated is for agriculture and farm related uses. Refer to Section 11. of the Durham Regional Official Plan. A rezoning to allow for residential development will require an amendment to the Durham Regional Official Plan. Staff suggest that Mr. Wesson contact the Durham Regional Planning Department in that regard. RECOMMENDATIONS: THAT the Planning and Development Committee recommend to Council that:- 1) A copy of this report be forwarded to the By-Law Enforcement Officer for appropriate action, and 2) A copy of this report be forwarded to Mr. D.A. Mcllroy, Town Clerk, Town of Newcastle, 40 Temper'anve Street,, Uowmanville, Ontario Dear Mr. MelZroy: There is at present a private Airplane landing strip situated on the land owned by Mr. Charles CabOur'ie. This land is described as being parts of Lots 31 & 321 Conc . Z in the former Township of Darlington. To my knowledge this air strip is a legal non-conforming usage of land .with regards to the ;coning by- laws. This property is presently for sale and I would like to know the intentions of Council insofar as the continued uses of this air strip with t,ho ;ale of this 'land. If l S Council in not in favour of retaining the air strip, ould they look favourabZy on re-;zoning this property to residential or estate residential?
