REPORT NO. : P-30-80 SUBJECT: Proposed Official Plan Amendment Section 7.2. 7 of the Durham Regional Official Plan File: 80-3/D BACKGROUND: On February 5, 1980, staff received the attached correspondence in respect of a proposed amendment to the Durham Regional Official Plan, which also requested the Town's comments in respect of the amendment. COMMENTS: The proposed amendment is apparently intended to permit local municipalities a degree of flexibility when considering mixed use pro- posals within Major Urban Areas. This is meant to supplement the present provisions of Section 7.2. 7 of the Durham Regional Official Plan. It is clear from the proposed wording that this would be a discretionary matter subject to the inclusion of appropriate provisions within the Town's District Plan. In that regard, staff do not have any objections to the proposed amendment provided it remains a discretionary policy since the Town may or may not wish to permit mixed uses in all components of the Major Urban Areas. In any case, appropriate provisions will be considered during the preparation of the Town's District Plan. / - 2 - RECOMMENDATION: That the Planning and Development Committee recommend to Council the following: 1. That report P-30-80 be received; and that 2. The Region of Durham be advised that the Town of Newcastle has no objection to proposed Official Plan Amendment 80-3/D. Respectfully submitted, g . Manager Strategic Planning Branch :LF Enclosure ecs Dean Smith, Planning Director, DURHAM Planning Department Commissioner' s Report to Planning Committee Report No. 80-21 Date: January 29 , 1980 SUBJECT PROPOSED AMENDMENT TO THE DURHAM REGIONAL OFFICIAL PLAN TO PERMIT MIXED USES WITHIN RESIDENTIAL AREAS RECOMMENDATION THAT the Planning Committee authorize staff to advertise in the appropriate newspapers that the Planning Committee and Regional Council will be considering an amendment to the Durham Regional Official Plan in accordance with Appendix ' I ' to Commissioner ' s Report No. 80-21. REPORT During the preparation of the Durham Regional Official Plan, it was determined that it might be desirable to permit a variety of uses in any component of the Major Urban Areas as is reflected by Section 7 .2 .7 which indicates the following: "It is the intent of Regional Council to work in conjunction with the Council of the respective area municipality to investigate ways and means of increasing the densities of new residential developments within the Major Urban Areas so as to reduce the per capita cost of public transportation facilities , to increase the efficiency of the use of land and to encourage the development of multi-functional areas" . Recently, during the processing of District Plans and particularly amendments to the Pickering District Plan, it has become apparent that an amendment to the Durham Regional Official Plan is necessary and desirable to permit mixed uses in any component of the Major Urban Areas . Such an approach is particularly desirable in areas in close proximity to Central Areas or along major transportation routes . The inclusion of such a policy would provide more flexibility to the Council of the respective area municipality if so desired, provided appropriate provisions are included in the respective District Plan. i9 Commissioner' s Report No. 80-21 Page 2 The proposed approach is consistent with the intent of Section 7. 2 . 7 of the Durham Regional Official Plan such that the development of multi-functional areas would be encouraged in order to increase the efficiency of the use of land. Commissioner of Planning VC/LK Attachment: Appendix ' I ' 20 V, << APPENDIX ' I ' Proposed Amendment to the Durham Regional Official Plan Purpose: The purpose of this Amendment to the Durham Regional Official Plan is to provide for mixed uses in any component of the Major Urban Areas subject to the inclusion of appropriate provisions in the respective District Plan. Basis: Following the review of several District Plans and amendments to such Plans, it has been determined that it may be desirable to permit mixed uses in any component of the Major Urban Areas . Actual The Durham Regional Official Plan is hereby amended Amendment: by adding the following to Section 7 . 2. 7. Therefore, mixed uses may be permitted in any component of the Major Urban Areas subject to the inclusion of appropriate provisions in the respective District Plan. " Implementation: The provisions set forth in the Durham Regional Official Plan, as amended, regarding the implementation of the Plan shall apply in regard to this Amendment. Interpretation: The provisions set forth in the Durham Regional Official Plan as amended, regarding the interpretation of the Plan shall apply in regard to this Amendment. 21
