SUBJECT: Correspondence of December 28, 1979 from Enniskillen
General Store
BACKGROUND:
The attached correspondence was considered by Town Council at
the Meeting of January 14, 1980. Council referred the correspondence
to the Planning and Development Department for a report to Committee.
Council members indicated that they wished comments in respect of para-
graph 3 of the letter.
COMMh ENT:
Attached, please find a copy of- a memorandum from the Chief
Building Official in respect of the signs permitted on the Enniskillen
.t.
General Store. It should be noted that an overhanging sign is not per-
mitted under By-law 76-25 . No request has been made to amend the sign
by-law to allow the overhanging sign in question.
At the present time, the overhanging sign is not permitted and
it is appropriate for the municipality to enforce its by-law on that
basis.

RECOMMENDATION:
That the Planning and DevelopmenL Committee recommend to
Council that the correspondence from the Enniskillen General Store
of December 28, 1979 be received for information.

SUBJ=, : Enniskillen General. Store
Early in 1979 Linda sweet of the Enniskillen General. Store
inquired as to the possibility of erecting an overhanging sign on the
northwest corner of the' building. At that time there was on the
building the frame of an old overhanging sign minus the display portion.
There had. not been a name or advertisement in the frame for several
years#
It was explained to Mrs. Sweet that an overhanging sign is
not permitted in Sign By-law 7625.
Section A 5) Prohibition of Certain Silts.
"No overhanging sign shall
be permitted".
Section 3(25) Definitions
"Sign, Overhanging" means any
sign which projects from a lot
across a street line to a
horizontal distance of more than
18 inches.
Due to the fact that there had not been a display portion
in the frame for several years, the view has been that it has cued
to be a sign.
Section 3(15) defines a "Sign" as a
structure or portion of a straotuwO
haviaag thereon any name, symbol,
description, illustration or device
which is used to identify or advertise
a person, place, product, object,
organization, activity or event.

The store is located in a CI Zone and identification signn
are permitted. Because the building is located on the property line
a wall identification sign is the only type that can be installed in
accordance with the sign by-law.
On May 139 1979, a sign Pe?m- it ims issued for the erection
of a 310" x 241011 sign on the north side of the building in accordance
with the followings
Section 8(2Ka
) iii - permits 2 identification
signs if the lot front$

permits a sign area
of 30 sq-ft- or 10% Of

To my knowledge a formal request was never made to amend
the sign By-law.
