SUBJECT:
EXTENSION OF NEWCASTLE BUSINESS IMPROVEMENT AREA
RECOMMENDATIONS:
1. THAT Report CD-21-89 be received;
2. THAT the extension of the Newcastle Business Improvement Area be approved and
the necessary by-law be forwarded to Council for passage; and
3. THAT Dr. J. Baarbe be so advised.
BACKGROUND AND COMMENT:
On May 29, 1989 Council referred to the Clerk, an item of correspondence from Dr.
J. Baarbe, Chairman of the Newcastle Business Improvement Area, requesting the
extension of the Business Improvement Boundaries.
In accordance with Section 217(2) of the Municipal Act, R.S.O. 1980, notice of
intention to pass the by-law was sent to all persons occupying or using land for the
purpose of, or in connection with, any business as shown in the .last revised
assessment roll.
The notice stated that affected persons may object to the passage of the by-law by
filing with the Clerk a petition signed by at least one-third of the persons
entitled to notice, representing at least one-third of the assessed value of the
lands in the area. Such petition must be filed within two months of the date of
mailing of the notices which, in this case, was September 21, 1989. No petitions
were received during the objection period.

It is, therefore, recommended that a by-law be forwarded to Council to extend the
boundaries of the Newcastle Business Improvement Area pursuant to Section 217(28)
of the Municipal Act, R.S.O. 1980, the by-law if passed, will come into effect
January 1, 1990.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 89-
being a By-law to amend By-law 81-2 of the
Town of Newcastle entitled a "By-law to
designate an area in the Village of Newcastle
Central Business District as an Improvement
Area and to establish a Board of Management
for the Village of Newcastle Central Business
Improvement Area. "
WHEREAS Section 217(26) of the Municipal Act provides that the
Council of a local municipality may pass by-laws for designating
as an improvement area an area that includes all of an existing
improvement area;
AND WHEREAS the Council of the Town of Newcastle has passed By-law
81-2 under Section 217(1) of the Municipal Act on the 5th day of
January 1981 designating an area in the Village of Newcastle
Central Business District as an Improvement Area and to establish
a Board of Management for the Village of Newcastle Central Business
Improvement Area;
AND WHEREAS Council deems it advisable to extend the said area;
AND WHEREAS notice of intention of the Council to pass a by-law
extending the Improvement Area as hereinafter described has been
given in accordance with Section 217(2) of the Municipal Act,
R.S.O. 1980, and no sufficiently signed petition objecting to the
passing of the by-law has been received within the time limit
therefore;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
NEWCASTLE HEREBY ENACTS AS FOLLOWS:
1. THAT Section 1 of By-law 81-2 be amended by deleting the said
section in its entirety and substituting the following
therefor:
1. The area hereinafter described is designated an
Improvement Area within the meaning of the Municipal Act.
The following is a description of the area:
King Street from and including the
property located at 210 King Street West
(McCrimmon's Antiques - The Hollows) on
the west to, and including, the property
located at 361 King Street East (Newcastle
Lumber Limited) .
2. This By-law shall come into effect on the lst day of
January, 1990.
BY-LAW read a first time this 30th day of October, 1989.
BY-LAW read a second time this 30th day of October, 1989.
BY-LAW read a third time and finally passed this 30th day of
October, 1989.
