J. BRUDEK ABRAM VARNUM HOUSE - MR. & MRS. W. MURRAY RECOMMENDATIONS: It is respectfully recommended that the General Purpose & Administration Committee recommend to Council the following: 1. THAT Report CD-20-89 be received; 2 . THAT the Mayor and Clerk be authorized to execute the appropriate by-laws; and 3. THAT the Clerk be authorized to carry out all actions necessary to complete the process of property designation pursuant to the Ontario Heritage Act, 1974, and detailed within Report CD-20-89 . BACKGROUND AND COMMENT: On September 26, 1989, Council adopted the Report of the General Purpose and Administration Committee, which dealt with the designations of the subject properties . As detailed in Report PD-183-88, the Clerk was authorized to proceed with the designating of the subject properties as historic properties . Continued . . . . . /2 601 Report CD-20-89 - 2 - October 23, 1989 The following actions were carried out: 1. By letters dated October 5, 1989, the property owners were requested to signify in writing, that they were prepared to undertake the designating of their properties . The consent forms have now been executed. 2 . Notice of Intention to Designate was forwarded to the owners of the properties and to the Ontario Heritage Foundation by Registered Mail on March 10, 1989 . The Notice of Intention to Designate was published in the local newspapers, once each week for three successive weeks - March 15, March 22, and March ,29, 1989 . 3 . By-laws to designate the properties pursuant to the Ontario Heritage Act, 1974, were prepared. The period for filing objections to the proposed designations ended on April 14, 1989 . No objections were filed either during or subsequent to the objection period. Having regard to the fact that no objections have been filed to the designating of the properties and the owners have consented to the designating, it is appropriate that the following actions now be undertaken: 1. THAT the by-laws to designate the properties be recommended to Council for passage; 2 . THAT the Clerk be authorized to publish Notices of Designation in the newspapers and forward a certified copy of the by-laws to the property owners and to the Ontario Heritage Foundation; 3. THAT a copy of the by-laws designating the properties be forwarded to the Town's Solicitor for registration on title so that future owners and anyone else that may be interested in the properties will be aware of the fact that they have been designated; and 4 . T Clerk Chief nistrative Officer 602 THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 89- being a by-law to designate the property municipally known as "The Abram Varnum House" located in Part of Lot 26, Concession 6, former Township of Darlington, now in the Town of Newcastle, Regional Munic'tdlity of Durham, as a property of architect­!al and historical value and interest which prn,'erty is more particularly described in the scl'edule attached WHEREAS the Ontario Heritage Act, 1974 authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as "The Abram Varnum House", located in Part of Lot 26, Concession 6, former Township of Darlington, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Canadian Statesman, a newspaper having a general circulation in the area of the designation, once each week for three consecutive weeks, namely March 15, March 22 and March 29, 1989; and WHEREAS The Abram Varnum House" in Part Lot 26, Concession 6, former Township of Darlington has a very significant architectural value of interest to the Town of Newcastle and its people in that the home is the finest and best preserved house in an important grouping of stone houses along the Seventh Concession, west of Solina Road. In particular, the well preserved random coursed fieldstone exterior; the original 6 over 6 sash; the exterior shutters and the returned eaves; the Regency glazing pattern of the transom and sidelights of the front door; the trillage verandah of the west wing, the finely detailed interior trim of the windows; the original pine floors; the small built-in cabinet with its original glazing in what is now the living room; the driving shed, a separate structure to the south of the house, which retains the original 6 over 6 sash and the original clapboard siding, and a fine random course fieldstone foundation are specifically designated as being of architectural value; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property "The Abram Varnum House", Part of Lot 26, Concession 6, former Township of Darlington, now in the Town of Newcstle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. There is designated as being of Architectural and Historical value of interest, the real property known municipally as "The Abram Varnum House" Part of Lot 26, Concession 6, former Township of Darlington, Regional Municipality of Durham. 2. The Municipal Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in the preceeding paragraph. 3. The Town Clerk is hereby authorized to cause a copy of this by-law to be served upon the owners of the aforesaid property and on the Ontario Heritage Foundation, and to cause notice of the passing of this by-law to be published in the Canadian Statesman, a newspaper having general circulation in the area of the designation, once each week for three consecutive weeks. Hanning Plan, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, as a property of architectural and historical value and interest which property is more particularly described in the schedule attached WHEREAS the Ontario Heritage Act, 1974, authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as 23 Mill Street, Block "Q", Lot 8, C.G. Hanning Plan, former Township of Clarke, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Newcastle Independent, a newspaper having a general circulation in the area of the designation, once each week for three consecutive weeks, namely, March 15, March 22 and March 29, 1989; and WHEREAS "St. Saviour's Anglican Church", located at 23 Mill Street North, Block "Q", C.G. Hanning Plan, former Township of Clarke, has a very significant architectural value of interest to the Town of Newcastle and its people in that the church was built in 1869, is a modest yet appealing example of Gothic Revival Architecture. The well preserved brick work, executed in the common bond style with pilasters and horizontal rows of decorative corbelling, a coursed fieldstone foundation; the original pine doors on the entrance; the large Gothic windows on three sides and the simple decorative brackets under the eaves; the timbered tongue and groove ceiling of Tudor design; the reredos, screen and altar rail; the original pine floor and decorative iron grates, the pine wainscotting; and the pews which retain the original sponge graining architectural value; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property "St. Saviour's Anglican Church", 23 Mill Street North, Block "Q", Lot 8, C.G. Hanning Plan, former Township of Clarke, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. WHEREAS the Ontario Heritage Act, 1974 authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owner of the lands and premises known as "The Daniel Hogarth House", located in Part of Lot 24, Concession 5, former Township of Darlington, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such notice of intention to be published in the Canadian Statesman, a newspaper having a general circulation in the area of the designation, once each week for three consecutive weeks, namely March 15, March 22 and March 29, 1989; and WHEREAS "The Daniel Hogarth House" in Part Lot 24, Concession 5, former Township of Darlington, has a very significant architectural value of interest to the Town of Newcastle and its people in that the red brick victorian home, was built by local farmer Daniel Hogarth in 1874 and remains in good condition today. In particular, the exterior brick work in the running bond pattern remains in good condition, the gingerbread trim is particularly the panelled wainscotting of the dining room, the simpler wainscotting of the kitchen and the panelling around the bottom of the bay window, and the original pine floors are being specifically designated as being of architectural value; and WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property "The Daniel Hogarth House", Part of Lot 24, Concession 5, former Township of Darlington, now in the Town of Newcastle, Regional Municipality of Durham, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1.
