SUBJECT: LIVESTOCK CLAIM - DIANE D'ANDREA
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council:
1. THAT Report CD-19-89 be received;
2. THAT the livestock claim submitted by Mrs. Diane D'Andrea in the amount of
$66.00 for damages caused by raccoons be denied;
3. THAT all future livestock claims for damages caused by wild animals other
than wolves or dogs be denied;
4. THAT Mrs. Diane D'Andrea, Mr. Syd Worden and Mr. Arnot Wotten be advised
of Council's decision.

The subject livestock claim was filed with the Clerk on July 3, 1989. The
claim, in the amount of $66.00, is for 22 chickens which were killed by
raccoons.
In accordance with the Dog Licensing and Livestock and Poultry Protection
Act, a municipality must pay for damages caused by dogs or wolves. All claims
for wolf damage are reimbursed to the municipality through the Ministry of
Agriculture and Food, however claims for dog damage are not reimbursed. Claims
for damages caused by all other wild animals must be decided by the Municipal
Council and if approved, paid by the municipality.
On June 26, 1989, Council considered a similar application filed by Mr. Ross
Cryderman. At that time, the claim was approved and staff commented that,
should this instance arise again, a recommendation would be put forth that a
by-law be passed under the Act fixing the maximum amount to be paid for damages.
Since that time, discussions have been held with Mr. Syd Worden and Mr. Arnot
Wotten, the Livestock Valuers for the 'Town and they have advised that since
approval of the first claim for damages caused by raccoons, numerous calls of
this nature have been received. 'Therefore, Staff is of the opinion that a
by-law should not be passed and all claims for damages other than those caused
by wolves or dogs should be denied.
