By-Law # MEETING: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: JUNE 19, 1989 REPORT #: CD-16-89 FILE #: 68.2.4 SMECT: LIVESTOCK CLAIM - ROSS CRYDERMAN RECOMMENDATIONS: 1. THAT Report CD-16-89 be received; 2. THAT the claim of $105.00 submitted by Mr. Ross Cryderman under Section 11(4) of the Dog Licensing and .Livestock Act be approved; and 3. THAT Mr. Cryderman be so advised. BACKGROUND AND COMMENT: On June 12, 1989, Mr. Arnot Wotten, Livestock Valuer for the Town of Newcastle, filed a livestock claim on behalf of Ross Cryderman. The claim, totalling $105.00, is for 105 chickens which were killed by raccoons on June 10, 1989. Continued.. .. ./2 604 Report CD-16-89 - 2 - June 19, 1989 On May 29, 1989 Council authorized payment of a livestock claim in the amount of $98.00 to Mr. Ferruccio Bianco for damage which was caused by raccoons. At that time, Council was informed that the municipality may, under Section 10(3) of the Dog Licensing and Livestock and Poultry Protection Act pass a by-law providing that where livestock or poultry are killed or injured by wild animals other than wolves, the municipality would be liable to the owner for the amount of damage. Council has not passed a by-law under Section 10(3) of the Act and therefore must determine whether the claim will be approved. It is staff's opinion that, in light of the fact that Mr. Bianco's claim was approved, the subject claim should be approved. However, if this instance should arise again, staff_ will be recommending that a by-law be passed by Council, fixing a maximum amount which will be paid for damages.
