By-Law � �} I MEETING: GENERAL PURPOSE & ADMINISTRATION COMMITTEE DATE: FEBRUARY 6, 1989 REPORT #: CD-3-89 FILE #: SU&JECT: HERITAGE DESIGNATIONS - 3 EDWARD STREET, NEWCASTLE (ST. GEORGE'S CHURCH & PARISH HALL) - 3496 LAMB'S ROAD, BOWMANVILLE (DR. AND MRS. MICHAEL MARTIN) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report CD-3-89 be received; and 2. THAT the Mayor and Clerk be authorized to execute the by-laws as attached to Report CD-3-89; and 3. THAT the Clerk be authorized to carry out all actions necessary to complete the process of property designation pursuant to the Ontario Heritage Act, 1974, and detailed within Report CD-3-89. BACKGROUND AND COMMENT On June 13, 1988, Council adopted the report of the General Purpose and Administration Committee which dealt with the designation of the subject properties as detailed in Report PD-117-88. The Clerk was authorized to proceed with the designating of the subject properties as historic properties. Continued . . . . ./2 Report CD-3-89 - 2 - February 6, 1989 The following actions were carried out: 1. By letter dated August 16, 1988 the property owners were requested to signify in writing that they were prepared to undertake the designating of their properties. All consent forms have been executed. 2. Notice of Intention to Designate was forwarded to the owner of the property and to the Ontario Heritage Foundation by Registered Mail. 3. Notice of Intention to Designate was published in the Canadian Statesman and the Newcastle Independent once each week for three successive weeks - October 26, November 2 and November 9, 1988• 4. By-laws to designate the properties, pursuant to the Ontario Heritage Act, 1974, were prepared (See attached) . The period for filing objections to the proposed designation ended on November 24, 1988• No objections were filed either during, or subsequent to the objection period. Having regard to the fact that no objections have been filed to the designating of the properties, and the owners have consented to the designation, it is appropriate that the following actions now be undertaken: 1. THAT the By-laws to designate the properties be recommended to Council for passage; and 2. THAT the Clerk be authorized to publish Notices of Designations in the newspaper, and forward a certified copy of the By-laws to the property owners and to the Ontario Heritage Foundation; and 3. THAT a copy of the By-laws designating the property be forwarded to the Town's Solicitor for registration on title, so that future owners and anyone else that may be interested in the properties will be aware of the fact that it has been designated; and Continued . . . . ./3 Report CD- - 3 - February 6, 1989 4. THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 89- being a by-law to designate the property known municipally as 113496 Lamb's Road", located in Part Lot 7, Concession 3, former Township of Darlington, now in the Town of Newcastle, Regional Municipality of Durham, as a property of architectural and historical value and interest WHEREAS the Ontario Heritage Act, 1974, authorizes the Council of a municipality to enact by-laws to designate real property including all the buildings and structures thereon to be of architectural and historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be r served upon the owner of the lands and premises known as 113496 Lamb's Road", located in Part of Lot 7, Concession 3, former Township of Darlington, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property and has caused such Notice of Intention to be published in the Canadian Statesman and the Newcastle Independent, having a general circulation in the area of the designation, once each week for three consecutive weeks, namely, October 26, November 2, and November 9, 1988; and WHEREAS 3496 Lamb's Road, in Part Lot 7, Concession 3, former Township of Darlington has a very significant architectural value of interest to the Town of Newcastle and its people in that the storey and a half brick house was built around 1855. In particular, it has a notable semi-circular fanlight set over the front door ,just below the eave line; it retains the returned eaves; the six over six glazing remains intact; it retains a fine front doorway flanked by moulded pilasters and surmounted by an entablature and overhanging cornice; the front door is surrounded by a rectangular transom of coloured glass and the sidelights feature fine Regency glazing; the interior floor plan remains largely unaltered; the original pine floors remain as does the kitchen wainscotting and the 15" baseboards in the front of the house; the wide detailing of the parlor windows remains; there is a finely turned cherry bannister on the front staircase, and on the east side of the rear wing are the remains of the original board and batten siding of the enclosed porch. WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property 113496 Lamb's Road", Part of Lot 7, Concession 3, former Township of Darlington, be designated under the terms of the Ontario Heritage Act; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. There is designated as being of Architectural and Historical value of interest, the real property known municipally as 9496 Lamb's Road", Part Lot 7, Concession 3, former Township of Darlington, now in the Town of Newcastle in the Regional Municipality of Durham. 2. The Municipal Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in the preceding paragraph, in the proper land registry office. ` 3. The Town Clerk is hereby authorized to cause a copy of this by-law to be served upon the owners of the aforesaid property and on the Ontario Heritage Foundation, and to cause notice of the passing of this by-law to be published in the Canadian Statesman and the Newcastle Independent, newspapers having general circulation in the area of the designation, once each week for three consecutive weeks. Hanning Plan (1868) for the Village of Newcasetle, former Township of Clarke, now in the Town of Newcastle and upon the Ontario Heritage Foundation, Notice of Intention to designate the aforesaid real property and has caused such Notice of Intention to be published in the Canadian Statesman and the Newcastle Independent, newspapers having a general circulation in the area of the designation, once each week for three consecutive weeks, namely October 26, November 2, and November 9, 1988; WHEREAS 113 Edward Street" in Part of Lots 16 and 17, Block 14 of C.G. Hanning Plan (1868) for the Village of Newcastle, former Township of Clarke has a very significant architectural value of interest to the Town of Newcastle and its people in that the interior and exterior of the Church and adjoining Parish Hall, designed by William Haty and constructed under his direction in 1857, are a classic example of original Gothic Church Architecture. In particular, the following features are designated: The Gothic Tower with broach steeple; the slate roof; the open arches and columns; the ceiling panelling; the early stained glass windows; the boxed pews, and the organ. Other additions to the church constructed about 1900 which are designated include the decorative painting on the east wall; the two large Tiffany windows (one over the alter, the other on the north wall); the vestry and its panelled west wall; the cabinet for hangings and the matching tables and chairs, and the brick boundary wall. As well, the exterior of the Parish Hall with its half-timbered porch and windows is also designated. WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property 113 Edward Street", Part of Lots 16 and 17, Block 14 of the C.G.
