RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report CD-43-88 be received for information.
BACKGROUND AND COMMENT:
Pursuant to the Education Act, R.S.O. 1980, a determination has been made with
respect to the distribution of the Trustees for the Northumberland & Newcastle Board
of Education.
As provided in the Act, the Clerks of the three largest municipalities in the Board's
jurisdiction, being the Town of Newcastle, the Town of Cobourg, and the Town of Port
Hope, met on August 3, 1988 to determine the distribution.
This report is submitted for information.

Trustee Distribution - The Northumberland and
Newcastle Board of Education - 1988 Municipal Election -
Our File: 10.50.5
A determination has been made pursuant to the Education Act
as amended and I would advise as follows:
1. The Northumberland and Newcastle Board of Education
at a special meeting held on August 3, 1988, passed
resolutions to provide that the size of the Board will
remain at 15 trustees for the 1988 election; and
2. That an alternative distribution will be applied on
the basis of two electoral groups. The County of
Northumberland will have 9 Trustees and the Town of
Newcastle will have 6 Trustees.
As provided in the Act, the Clerks of the three largest
municipalities in the Board's jurisdiction, being the Town of
Newcastle, the Town of Cobourg and the Town of Port Hope,
met on Wednesday, August 3, 1988 and determined the Trustee
distribution. The determination report is attached and indicates
the municipalities to be represented by each Trustee.

Finally, I would advise that the Clerks of the following
municipalites should review their responsibilities for the
combined areas;
1. Township of Murray
2. Township of Seymour
3. Town of Port Hope
4. Town of Cobourg
For your additional information, I have attached a copy of
the regulation made under the Education Act respecting Trustee
distribution and a copy of a resolution passed by the
Northumberland and Newcastle Board of Education August 3,
1988.

REGULATION MADE UNDER THE
EDUCATION ACT
TRUSTEE DISTRIBUTION
1 . In this Regulation "major part" means , with respect to
a county or regional municipality, an area in the county or
regional municipality that is larger than 50 per cent of the
geographic area of the county or regional municipality, as the
case may be.
2.-( 1 ) Subject to subsections (2) , (3) and (4) , a
determination and a distribution under Part VIIA of the Act
with respect to a board shall be made by the clerks of the
three municipalities within the area of ,jurisdiction of the
board having successively the greatest population.
(2) Where the area of jurisdiction of a board comprises
fewer than three municipalities , the clerk of the municipality
having the largest population, in consultation with the clerk
of the other municipality, where applicable, shall make a
determination and a distribution.
(3) Where the area of jurisdiction of a board is composed,
wholly or partly, of all or the major part of two or more
counties a determination and a distribution shall be made by
the clerk of the municipality in each county having the largest

population, and where there are fewer than three counties in
the area of ,jurisdiction of the board, by the clerk of the
municipality, in the area of jurisdiction of the board, having
successively the next largest population.
(4) Where the area of jurisdiction of a board comprises a
county or the major part of a county and a regional
municipality or the major part of a regional municipality, a
determination and a distribution shall be made by the clerk of
the municipality having the largest population in the county
and the clerk of the municipality having the largest population
in the regional municipality and the clerk of the municipality,
in the area of jurisdiction of the board, having successively
the next largest population.
(5) The director of education of a board shall take the
necessary steps to convene a meeting of the persons required to
make the determination and distribution for the board and shall
be consulted during the process of making a determination of or
a distribution for the members of the board.
(6) A determination and a distribution shall be mabe
within ten days of receipt of the enumeration list from the
assessment commissioner and, in any case, shall be made not
later than the 10th day of August in the year of a regular
election under the Municipal Elections Act.

(8) Where the members of a board who represent an
electoral group direct that an alternative distribution be
made , the distribution shall be made on or before the twenty
fifth day after the receipt of the enumeration list from the
assessment commissioner and , in any case , not later than the
25th day of August.
(9 ) On or before the twenty-fifth day after the receipt of
the enumeration list from the assessment commissioner and, in
any case, not later than the 25th day of August in the year of
a regular election under the Municipal Elections Act , the clerk
of the municipality having the largest population shall send by
registered mail a copy of the alternative distribution for an
electoral group of a board to the Minister, the secretary of
the board and the clerks of all municipalities , including a
regional municipality, and counties that are all or partly
within the area of jurisdiction of the board.

( 10) Where a municipality is divided into electoral areas
for the election of board members, other than electoral areas
established under section 2771 of the Act , and the clerk of the
municipality is not a person prescribed to make a distribution ,
the clerk may make recommendations on the distribution to be
made to electoral areas within the municipality.
( 11 ) The clerk of a county may make recommendations on
combining municipalities within the county for the election of
members of a board.
( 12) Despite subsection (6) 0 for the purposes of a regular
election to be held in 1988 under the Municipal Election Act , a
determination and a distribution shall be made not later than
the 15th day of August, 1988.
( 13) Despite subsection (7) , for the purposes of a regular
election to be held in 1988 under the Municipal Election Act ,
the clerk of the municipality having the largest population
shall , on or before the 15th day of August, 1988 , send by

\ registered mail a copy of the determination and the
distributions for a board to the Minister, the secretary of the
board and the clerks of all the municipalities , including a
regional municipality, and counties that are all or partly
within the area of jurisdiction of a board.

( 14) Despite subsection (8) , where the members of a board
who represent an electoral group direct that an alternative
distribution be made for the regular elections to be held in
1988 under the Municipal Elections Act , the alternative
distribution shall be made not later than the 25th day of
August, 1988.
( 15) Despite subsection (9) , where the members of a board
who represent -an electoral group direct that an alternative
distribution be made for the regular elections to be held in
1988 under the Municipal Elections Act , the clerk of the
municipality having the largest population shall , on or before
the 25th day of August, 1988, send by registered mail a copy of
the alternative distribution to the Minister, the secretary of
the board and the clerks of all the municipalities , including a
regional municipality, and counties that are all or partly
within the area of jurisdiction of the board.
( 16).-In-Addition-to--the ._copies .required to be sent .under _
subsections (7) and .( 1 3),_.the _clerk _.shall include a reference

to the motion in the minutes .-of__.the board . that authorizes an
increase or decrease in the number of members by one .o.r two,
where applicable. and. _the data and calculations by which the
determination and distributions were made.

( 17) In addition to the copies required to be sent under
subsections (9) and ( 15) , the clerk shall include the reference
to the motions in the minutes of the board that authorize the
alternative distribution and the data and the calculations by
which the alternative distribution was made.

3. -( 1 ) Where two or more municipalities are combined for
the election of one or more members, the nominations shall be
submitted to the returning officer of the municipality, in the
combination of municipalities that has the greatest population.
( 2) Where all or part of two or more municipalities are
included in an electoral area established under section 277i of
the Act , the nominations shall be submitted to the returning
officer of the municipality that has the greatest population .
( 3) The returning officer who cond'uets the nominations
shall send, by registered mail within forty-eight hours after
the closing of nominations , to the clerk of each municipality
that is included in the combination of municipalities or that
is situated all or partly within the electoral area, as the
case may be, the names of the candidates who have qualified .
(4 ) The clerk of a municipality shall be the returning
officer for the vote to be recorded in the municipality.
(5) The clerk of a municipality shall report the vote
( recorded to the returning officer to whom nominations were
submitted under subsection ( 1 ) or (2) and the returning offioer
shall prepare the final summary and announce the result of the
vote.
(6) For the purposes of this section, •.the secretary of a
board shall be the clerk of each part of territory without
municipal organization that is deemed a district municipality
in the area of jurisdiction of the board.

(7 ) In this section, "municipality" includes territory
without municipal organization that is deemed to be a district
municipality under subsection 52(3) of the Act.
4. -( 1 ) Section 3 of Regulation 267 of Revised Regulations
of Ontario, 1980 is revoked.
(2) Section 4 of the said Regulation, as amended by
section 1 of Ontario Regulation 277/85 , is revoked.
5. Section 4 of this Regulation comes into force on the
1st day of December, 1988.

1 . THAT the Board designate the Town of Newcastle as a low population
municipality.
2. THAT an alternative distribution of members be made to the Town of
Newcastle - Ward III (Clarke) so that the sum of the electoral
quotients for the Town of Newcastle be increased by one trustee.
3. THAT the distribution of trustees for the 1988 election be recommended
as follows by grouping;
