RECOMMENDATIONS: 1. THAT Report CD-35-88 be received; and 2. THAT the Tile Drainage Loan Application submitted by Walter Pingle in the amount of $19,700.00 be approved; and 3. THAT the By-law attached to Report CD-35-88 be approved and the By-law and necessary support documents be forwarded to the Regional Municipality of Durham for processing; and 4. THAT the applicant be advised of Council's decision. BACKGROUND AND COMMENT: Mr. W. Pingle filed an application for a Tile Drainage Loan in the amount of $24,700.00, on April 12, 1988. The works were completed by May 16, 1988, and subsequently invoices totalling $26,260.30 were submitted for the Works Department's review. The Drainage Inspector inspected the works and filed an Inspection and Completion Certificate on May 16, 1988, in the amount of $19,700.00. Continued . . . . ./2 Report CD-35-88 - 2 - July 4, 1988. We have been advised by the Ministry of Agriculture and Food, that the Town of Newcastle's budget for the Tile Loan Program for 1988 is $19,500.00. On June 13, 1988, Council approved a Tile Drainage Loan Application in the amount of $8,800. However, in a conversation with Mr. John Johnston of the Ministry of Agriculture and Food on June 21, 1988, we were advised to process Mr. Pingle's application. Any further applicants will be informed that there is no additional monies budgetted for Tile Drainage Loans until August 1988. It is, therefore, recommended that the Tile Drainage Loan Application in the amount of $19,700.00 be approved, the necessary by-law forwarded to Council for passage and the application, when approved by Council, forwarded to the Region for processing. PLB/ms THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 88- W being a by-law imposing special annual drainage rates upon land in respect of which money is borrowed under The Tile ;{ Act 1971 !I i WHEREAS owners of land in the municipality have applied to the Council under the Tile Drainage Act, 1971, for a loan for the purpose of constructing sub-surface drainage works on such lands; AND WHEREAS the Council of the Corporation of the Town of Newcastle has upon their application lent the owners the total sum of $19,700.00 to be repaid with interest by means of rates hereinafter imposed. ;i BE IT THEREFORE ENACTED BY THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE, that annual rates as set out in Schedule "A" attached hereto are hereby imposed upon such land for a period of 10 years, such rates to be levied and collected in the same menner as taxes. ,•M By-law read a first and second time this By-law read a third time and finally passed this I, 3..t Mayor . f..
