SUBJECT:
REPORT RESPECTING LIQUOR LICENCE -
COSY COUNTRY RESTAURANT AND ALLEGED
LIQUOR ABUSES IN THE BOWMANVILLE MALL
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose & Administration Committee
recommend to Council the following:
1. That Report CD-33-88 be received for information; and
2. That a copy of the Report forwarded to Durham Regional Police for their
information, and they be requested to investigate the complaint related to
the consumption of alcoholic beverages in the Bowmanville Mall, in other
than licenced premises.
BACKGROUND AND COMMENT:
Council at the meeting of March 28, 1988, passed the following resolution:
"THAT the By-law Enforcement Officer be requested to
meet with officials from the L.C.B.O. , regarding alledged
abuse of the Liquor Licensing Act at the Bowmanville Mall;
AND FURTHER THAT he be requested to report to the General
Purpose and Administration Committee regarding similar
circumstances at the Waverley Plaza and the related
licensing process."

Briefly, the matters referred to were discussed with representatives of the Liquor
Licensing Board and with respect to infractions in the Bowmanville Mall, we were
advised to report the matter to Durham Regional Police for investigation. The
Liquor Licensing Board does not provide for investigation of such offences within
its staff; Police Departments do this as part of their regular duties. It would
be appropriate, therefore, to request that the Regional Police investigate the
complaints related to the consumption of alcohol in the Bowmanville Mall.
The Cosy Country Restaurant Liquor Licence was also discussed and, an investigation
was carried out by the Liquor Licence Inspection Branch of the Board. Apart from
the fact that the restaurant was closed permanently, the Board representatives
agreed to withdraw the Liquor Licence and, should any applications be received in
future relating to these premises, the Board would treat the application as a new
one and circulate the municipality for comment as part of the licensing process.
Council could then express their concerns and have them considered by the Board.
In support of our request for cancellation of the licence for the closed business,
the Board was sent copies of the court documents related to the prosecution of the
owners for contravening the noise by-law.
As of this date, we have not been advised by the Board that their revocation
process has been completed. However, we have been assured that this will be
forwarded in due course.

Accordingly, it is recommended that this report be received for information and a
copy forwarded to Durham Regional Police with a request that they investigate the
complaint respecting the consumption of alcoholic beverages in the Bowmanville Mall
in other than the licenced premises.
