By-Law # MEETING: GENERAL PURPOSE & ADMINISTRATION COMMITTEE DATE: JULY 4, 1988 REPORT #: CD-31-88 FILE #: SUBJECT: REPORT WITH RESPECT TO A BY-LAW TO REGULATE AND GOVERN SECOND HAND SHOPS AND DEALERS IN SECOND HAND GOODS RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That Clerk's Report CD-31-88 be received; and 2. That a by-law to regulate and govern second hand goods shops and dealers in second hand goods be recommended to Council for passage; and 3. That all businesses covered by the by-law be given notice of the passing of the by-law and advised that the by-law will come into effect as of January 1, 1989; and 4. That Durham Regional Police be advised of Council's decision. BACKGROUND AND COMMENT: The subject matter was previously dealt with by the General Purpose and Administration Committee at the meeting of January 19, 1987. Continued . . . . ./2 (C) P.eport CD-31-88 - 2 - July 4, 1988 In May 1988, a Member of the Durham Regional Police Department attended at my office for the purpose of requesting that the Town consider the passing of a by-law to regulate Second Hand Shops and Dealers in Second Hand Goods. The officer was advised that the matter had been dealt with a year earlier and tabled in Committee. Council at the meeting of June 13, 1988, considered correspondence from Chief Jenkin on the subject of the Licensing of Second Hand Shops and directed "that a report and a draft by-law be prepared for the consideration of the General Purpose and Administration Committee." A copy of the Clerk's previous Report, (CD-1-87) and the draft by-law now amended in Section 19 to read "thirty days" as the retention period, are attached for the Committee's information. A new section numbered 28 has also been added to provide for the implementation of the by-law effective January 1, 1989. Passage of this by-law will, I am advised, be of great assistance to Durham Regional Police and its approval is recommended by staff.
