By-Law # MEETING: General Purpose and Administration Committee DATE: Tuesday, April 5, 1988 REPORT #: CD-10-88 FILE #: 68.29.1 SUBJECT: Amendment to By-law #87-156, the same being a by-law to provide for licensing and regulating the keeping of dogs RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: (1) THAT this report be received; and, (2) THAT By-law #87-156 be amended to include a definition of "running at large" ; and, (3) THAT the attached by-law be forwarded to Council for passage. BACKGROUND AND COMMENT: While preparing an argument for Court under Town of Newcastle By-law #87-156, the same being a by-law to provide for licensing and regulating the keeping of dogs, the author of this report discovered,and is of the opinion that, the Section dealing with "running at large" is not sufficiently defined so as to obtain a successful prosecution. It is therefore recommended that the interpretation section of the subject by-law be amended to include the following definition : "Running at Large" - A dog shall be deemed to be running at large when found in any place other than the property of the owner of the dog and not under the control of any person. If THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 88- being a by-law to amend By-law 87-156 entitled a by-law to provide for the licensing, regulating and keeping of dogs WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 87-156 of the Corporation of 'i the Town of Newcastle I` NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: •', '? 1.
