SUBJECT: LAND ACQUISITION - TOWN OF NEWCASTLE - BOWMANVILLE
ARENA LANDS, HWY. No. 2 AND REGIONAL ROAD 57 -
AMENDING BY-LAW 86-121 TO CORRECT DESCRIPTION DEFECT
RECOMMENDATIONS:
It is respectfullylrecommended that the General Purpose and Administration
Committee recommend to Council the following:
1 . That Clerk's Report CD-64-86 be received; and
2. That the attached by-law to amend By-law 86-121 which amending by-law is
intended to correct a description defect be recommended to Council for
passage; and
3. That the amending by-law be forwarded to the Town's Solicitor for registration.
BACKGROUND AND COMMENT
On September 30th 1986, the Town of Newcastle acquired the lands for the new arena
at Highway 2 and Regional Road 57. The by-law authorizing the transaction, namely
By-law 86-121 , was subsequent to its being registered, found to have a defect in it.
More particularly, the property description was not sufficient for registration,
in that it described the lands as being in "Part of Lot 15, Concession 1", when
it should have described the lands as being in"Part of Lot 15 and 16, Concession
1 . "

The Registry Office his asked through the Solicitor, that an amending by-law
containing the correct property description be passed and registered on title.
The amending by-law has been reviewed by Mr. Brady of Sims, Brady & McInerney,
and satisfies the concerns of the Registry Office. It would be appropriate to
recommend the by-law to Council for passage, following which it will be forwarded
to Mr. Brady for registration.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 86-
being a by-law to amend By-law 86-121, entitled
"a by-law to authorize the execution of an
Agreement of Purchase and Sale with The Schleiss
Corporation Ltd., and Rayev Investments Ltd., and
the Corporation of the Town of Newcastle"
(Bowmanville Arena Lands)
THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS
AS FOLLOWS:
1. THAT Section 1 of By-law 86-121 is hereby repealed and the following
Section 1 substituted therefore:
Section 1. THAT the Mayor and Clerk are hereby authorized
to execute on behalf of the Corporation of the
Town of Newcastle, and seal with the Corporation's
Seal, an Agreement of Purchase and Sale between
The Schleiss Corporation Ltd., and Rayev Investments
Ltd., and the said Corporation, dated the 28th day
of July 1986, in the form attached hereto as
Schedule "A", with respect to the acquisition of
22.65 acres of land, being Part of Lot 15 and 16,
Concession 1, Town of Newcastle (formerly the
Geographic Township of Darlington), in the
Regional Municipality of Durham, designated as
Parts 23, 24, 25, 26, 27, and 28, Plan 10R-574,
save and except thereout and therefrom that
portion of Lot 15, Concession 1, designated as
Parts 1 and 2, Plan 10R-1396.
