By-Lary # MEETING: General Purpose & Administration Committee DATE: March 17, 1986 REPOT #: CD-17-86 FILE #: 60.52.132 SU3,ECT: Request by Mr. & Mrs. Paul MacDonald, R. R. #3, Bowmanville, for Permission to Occupy an Existing Residence During the Construction of a New Residence Located in Part Lot 30, Concession 3, former Darlington (Nash Road) RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1 . That Report CD-17-86 be received; and 2. That the application be approved; and 3. That the applicants be required to obtain both a building permit and a demolition permit and comply with all other municipal requirements; and 4. That the Mayor and Clerk be authorized to execute the standard agreement permitting the use for a period not exceeding six months; and 5. That Mr. & Mrs. Paul MacDonald, R. R. #3, Group 23, Box 31 , Bowmanville, Ontario, L1C 3K4, be advised of Council 's decision. BACKGROUND AND COMMENT: Mrs. Donna MacDonald, the registered owner of the property located in Part Lot 30, Concession 3, former Township of Darlington (Nash Road) has written requesting that she and her husband be permitted to occupy the existing residential dwelling while a new residence is constructed on the same property immediately behind the present structure. Mrs. MacDonald indicated that the new home would be completed within three . . .12 _ 2 _ Report CD-17-86 months from commencement of construction. However, it would be appropriate to permit the occupancy for a period not exceeding six months, that being the normal period of approval . The Planning Department (P. Neilsen) indicated that they have no objection to the proposal , save only that it would be prudent to require that the applicants obtain both a building permit for the new residence and a demolition permit for the existing residence at the same time. This would ensure that all parties would have a clear understanding of what their obligations were. The request for permission to occupy an existing dwelling during the construction of a new residence is reasonable and staff would recommend its approval . Respectfully submitted, David W. Oakes, B.A. ,A.M.C.T. ,C.M.O. Town Clerk.
