SUBJECT:
CONSIDERATION OF A DEBENTURING BY-LAW TO PROVIDE FUNDING
FOR WORKS UNDERTAKEN PURSUANT TO THE SHORELINE PROPERTY
ASSISTANCE ACT, 1973.
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1 . That Clerk's Report CD-8-86 be received; and
2. That a debenturing by-law in the amount of $150,000 to aid in the construction
of works and building repairs under the Shoreline Property Assistance Act be
authorized; and
3. That Council give two readings to the by-law and direct the Clerk to obtain all
of the necessary approvals and, upon receipt of the said approvals, present the
by-law to Council for third reading; and
4. That following passage of the by-law by Council, the Clerk arrange to file a
certified copy of the by-law in the Registry Office.
BACKGROUND AND COMMENT:
The General Purpose and Administration Committee, at the meeting of January 20, 1986,
received the Administrator's Report Admin 5-86, entitled "Shoreline Erosion" for
information. This report outlined briefly the methodology to be followed and the
Ministrkes to be contacted by individual property owners who might wish to undertake
an erosion control program.

The newspapers have carried accounts of the erosion problems being experienced by
the owners of lands fronting on Lake Ontario. As well , individual members of
Council have been asked by the residents what can be done to protect their lands
from erosion.
In 1974, the Council of the day passed a by-law raising $50,000 for shoreline
property assistance. Six years later ( 1980) Council authorized an advance to an
area resident of $18,000 for shoreline property protection. At this point in time,
we have a balance of $32,000 remaining on the original debenturing by-law. It is
the opinion that given the time it takes to obtain the necessary Regional and
Ontario Municipal Board approvals, it would be prudent to implement the process
now; assuming that Council wishes to make the program available to residents of
the community. Further, given the amount of waterfront property we have in the
Town of Newcastle, it would be wise to obtain debenturing approval in an amount
sufficient to cover our requirements for more than one or two years. Assuming that
property owners along the waterfront wish to participate in the program, and
assuming the provincial government makes funds available for this purpose, and
bearing in mind that costs associated with shoreline rehabilitation or stabilization,
it would be reasonable to obtain approval of a debenturing by-law in the amount of
$150,000. A draft by-law is attached for the Committee's review and consideration.
