REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF
MAY 7th, 1984.

SUBJECT: HERITAGE DESIGNATION "BLEAKLEY HOUSE",
99 CHURCH STREET, BOWMANVILLE, ONTARIO,
OWNERS: IRWIN AND JANICE HAMILTON.
RECO14MENDATIONS:
It is respectfully recommended, that the General Purpose and Administration
Committee recommend to Council the following:
1 That this report be received; and
2. That the by-law attached to Report CD-29-84 be forwarded to Council for
passage; and
3. That the Clerk be authorized to carry out all of the actions necessary
to complete the process of property designation pursuant to The Ontario
Heritage Act, 1974, and detailed within Report CD-29-84.
BACKGROUND AND COMMENT:
On January 23rd 1984, Council adopted the Report of the General Purpose and
Administration Committee which directed, "that the Clerk prepare, send
and publish the required notices of intent, pursuant to Section 29 of
The Ontario Heritage Act, 1974, and to report back to Council following
the prescribed notification period with respect to the designating of
"Bleakley House", 99 Church Street, Bowmanville.
In accordance with Council 's direction the following actions were carried
out:

1 . Notice of Intention to Designate was forwarded to the owners of the
property, and to the Ontario Heritage Foundation by Registered Mail ,
dated February 29th 1984;
2. Notice of Intention to Designate was published in the Canadian
Statesman once each week, for three successive weeks, February 29th
March 7th and March 14th 1984;
3. A legal description of the subject property was requisitioned from Mr.
Merrill Brown, O.L.S. ;
4. A by-law to designate the property pursuant to The Ontario Heritage
Act, 1974, was prepared (copy attached).
REPORT:
The period for filing of objections to the proposed designation ended on
March 30th 1984, and I would advise that no objections were filed during
the objection period, nor have any objections been filed subsequent thereto.
Having regard for the fact, that no objections to the designating of the
property have been filed, and that the owners have consented in writing to
the designation, it is appropriate that the following actions be taken:
1 . That the by-law to designate the property be recommended to Council
for passage; and
2. That the Clerk be authorized to publish a Notice of Designation in the
newspaper, and forward a certified copy .of the by-law to the
property owner and to the Ontario Heritage Foundation; and
3. That a copy of the by-law designating the property be forwarded to
the Town' s Solicitor -for registration on title, so that future owners
will be aware of the fact that the property has been designated; and
4. That the Local Architectural Conservation Advisory Committee (LACAC)
be advised that the property has been designated.

BY-LAW 84- ('a 0
being a by-law to designate the property
known municipally as 99 Church Street,
Bowmanville, as being of Architectural and
Historical Value or Interest
WHEREAS The Ontario Heritage Act, 1974, authorizes the Council of
a Municipality to enact by-laws to designate real property, including
all the buildings and structures thereon, to be of architectural
or historical interest;
WHEREAS the Council of the Corporation of the Town of Newcastle has
caused to be served upon the owners of the lands and premises known as
"The Bleakley House" at 99 Church Street, in the former Town of Bowmanville
and upon the Ontario Heritage Foundation, Notice of Intention to so
Designate the aforesaid real property and has caused such Notice of
Intention to be published in the Canadian Statesman, a newspaper having
a general circulation in the Municipality, once for each of three consecutive
weeks, namely; February 29th, March 7th and March 14th 1984; and
WHEREAS the property at 99 Church Street, in the former Town of Bowmanville
has a very significant architectural and historical value,of interest to
the Town of Newcastle and its people, in that the property forms an integral
part of the nineteenth century streetscape;and has served as the residence
of two prominent members of the community.
WHEREAS the Local Architectural Conservation Advisory Committee of the
Town of Newcastle has recommended that the property at 99 Church Street,
in the former Town of Bowmanville, be designated under the terms of the
Ontario Heritage Act, 1974; and
WHEREAS no notice of objection to the proposed designation has been served
upon the Clerk of the Municipality;
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
hereby enacts as follows:
1. There is designated as being of architectural and
historic value of interest, the real property known
as "The Bleakley House" at 99 Church Street, in the
former Town of Bowmanville, now in the Town of
Newcastle, more particularly described on Schedule
"A" hereto.
2. The Municipal Solicitor is hereby authorized to cause
a copy of this by-law to be registered against the
property described in Schedule "A" hereto, in the
proper land registry office.
3. The Town Clerk is hereby authorized to cause a copy
of this by-law to be served upon the owners of the
aforesaid property and on the Ontario Heritage
Foundation and to cause notice of the passing of
this by-law to be published in the Canadian
Statesman, a newspaper having general circulation
in the Municipality, once for each of three
consecutive weeks.

ALL AND SINGULAR that certain parcel or tract of land and premises
known as 99 Church Street, Bowmanville, situate, lying and being in
the Town of Newcastle, Regional Municipality of Durham, Province of
Ontario, and being composed of parts of Lots One (1) , Two (2) and
Three (3), Block "R", according to the John Grant Plan of the former
Town of Bowmanville, said parcel or tract being more particularly
described as follows:
PREMISING that the bearing of the west side of George Street of the
said Town is North 18 degrees 30 minutes East and all bearings herein
being related thereto;
COMMENCING at a point in the North-east angle of said Lot 3, being
the intersection of the Southerly limit of Church Street of said Town
with the Westerly limit of George Street;
THENCE South 1$ degrees 30 minutes West in and along the Westerly limi
of George Street, 116 feet 8 inches more or less to a point distant
Northerly along the said limit of George Street, 258 feet 8 inches
from its intersection with the Northerly limit of King Street of said
Town;
THENCE North 75 degrees 4.9 minutes West 130 feet 81 inches to a point
in line with a fence running Northerly;
THENCE Northerly in and along said fence and its production Northerly
123 feet 12 inches more or less, in a straight line to the intersectio
with the Southerly limit of Church Street, said intersection beinf
distant Westerly in and along the said Southerly limit 131 feet 92
inches from the place of beginning;
THENCE Easterly in and along the said limit of Church Street 131 feet
9k inches more or less to the place of beginning.
