REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF
MARCH 19, 1984.
CD-19-84 - File: 60.52.117.
SUBJECT: REQUEST FOR EXTENSION OF AGREEMENT WITH RESPECT TO THE
OCCUPYING OF AN EXISTING DWELLING DURING THE CONSTRUCTION
OF A NEW RESIDENCE. MR. & MRS. SALVATORE RISORTO,
LOT 35, CONCESSION 4, DARLINGTON.
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. That Report CD-19-84 be received; and
2. That the request for an extension of the agreement granting Mr. and Mrs.
Salvatore Risorto the right to occupy the existing residence during the
completion of their new residence until June 30th 1984 be approved; and
3. That the Town of Newcastle reaffirm its requirement that the old
residence be demolished as soon as the new dwelling is occupied by the
Risorto's, or by June 30th 1984, whichever occurs first.
BACKGROUND AND COMMENT:
The Committee considered Report CD-36-83 on June 6th 1983. The subject Report
recommended approval of the Risorto's request for permission to occupy an
existing dwelling during the construction of a new residence on the same
property. Committee approved the report and Council authorized execution
of the necessary agreement on June 13th 1983.

By letter dated February 10th 1984, (copy attached) Mr. Anthony E. Laskowsky,
Solicitor, has on behalf of the Risorto's, requested that the six month
limitation be extended to June 30th 1984. Mr. Laskowsky cites financial
problems as the reason for his clients ' application for the extension.
The Planning Department reviewed the request and suggest, that the house
appears to be substantially complete as of the date of the last inspection.
In response to the Planning Department's concerns, it would be fair to point
out, that the period of extension encompasses both the completion of the
new residence, and the demolition of the old residence. In this circumstance,
the extension requested is appropriate.
Finally, if the extension is granted, it would be appropriate for the Town
to reaffirm its requirements with respect to the demolition of the old
residence by June 30th 1984.

Please be advised that the new residence on the above property is
presently under construction with all the rough—in completed and the gyproc
installed ready for plastering, which plastering is to commence in the next
two weeks. The delay in construction has been due to financial problems due
to the fact that Mr. Risorto, as a brick layer, can find little work during
the winter months.
It is anticipated that the building will be fully completed by the
30th day of June, 1984, and we would request an extension to demolish the old
residence until the 30th. day of June, 1984,.
