CD-14-84 - File: 10.13.99. SUBJECT: REPORT WITH RESPECT TO THE PROPOSED BY-LAW TO REGULATE, GOVERN AND PROHIBIT THE OPERATION OF MOTORIZED SNOW VEHICLES IN THE TOWN OF NEWCASTLE RECOMMENDATIONS: It is respectfully recommended, that the General Purpose and Administration Committee recommend to Council the following: 1. That this report be received; and 2. That the attached by-law respecting the regulating, governing and prohibiting the operation of motorized snow vehicles within the Town of Newcastle be approved. BACKGROUND AND COMMENT: On January 3rd 1984, the General Purpose and Administration Committee directed that, a by-law be prepared which would regulate the operation of snowmobiles in the Town of Newcastle. The Committee received the Clerk's report and draft by-law at the meeting of January 16th 1984. Following a brief discussion of the contents of the draft by-law, the Committee directed that it be forwarded to the Town's solicitors for review and comment. By letter dated January 30th 1984, Mr. John Brady, Solicitor, Sims, Brady and McInerney, identified and commented upon various sections of the draft by-law. (A copy of his letter is attached for your information) Continued . . . . .12 � �! t, V 6 CD-14-84 - 2 - February 6, 1984 The draft by-law has been revised bearing in mind, Mr. Brady's comments. More particularly, the recitals now indicate that the by-law is passed pursuant to "the Motorized Snow Vehicles Act R.S.O. 1980, Chapter 301," Section 6 has been altered and the phrase "except when returning home," deleted. The Committee may wish to extend the hours of operation to read, "12:00 midnight to 6:00 a.m. " rather than "11:00 p.m. to 6:00 a.m. " The penalty section is left as it is for the sake of clarity of action. References to other Acts might lead to confusion when the by-law is being enforced in the field. Finally, for the sake of continuity, I have moved Section 4. It is renumbered Section 2. If Members of the Committee are satisfied that their concerns have been met, it would be appropriate to recommend the by-law to Council for enactment. Respectfully submitted. i r ff�fi ` David W.
