RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-114-02 be received;
2. THAT the sign by-law amendment application submitted by Baywood Homes to permit
an 8.92 square metre promotional construction sign be APPROVED;
3. THAT the attached amending by-law be APPROVED by Council; and
4. THAT all interested parties listed in this report and any delegation be advised of
Council's decision.

1.0 LEGISLATION
1.1 Section 207, Subsection 146 of the Municipal Act allows Council to authorize
amendments to the Sign By-law if, in the opinion of Council, the general intent and
purpose of the by-law is maintained.
2.0 BACKGROUND AND PROPOSED AMENDMENT
2.1 The subject lands are located within Part Lot 9, Concession 2, in the former Town of
Bowmanville (see Attachment 1). The proposed location of the sign is Lot 27 on draft
approved plan of subdivision 18T-89064. The sign would be located at the rear of the
property and would be visible from Mearns Avenue.
2.2 The Sign By-law currently permits a 3 square metre promotional construction sign on a
residential property. A 5 square metre promotional construction sign is permitted on
commercial properties, such as new homes sales office sites and model homes. The
applicant is requesting permission to erect an 8.92 square metre sign on the subject
lands. Promotional construction signs are temporary in nature and are permitted on a
property for a maximum of one year.
3.0 STAFF COMMENTS
3.1 The intent of the Sign By-law is to control signage; however, that may be in contrast to
the builder's desire for visibility to advertise their new home product. Recent applications
for site plan approval for new homes sales offices and model homes have also
addressed increases in the size and number of signs as builders want more display
material than the by-law permits. Through the site plan approval process the sizes of
promotional construction signs have been varied to as large as 11.89 square metres. In
this instance, as there was no other development associated with the proposed sign, site
plan approval was not appropriate.
3.2 The subdivision site itself has limited exposure from major roads. It can only be
accessed through the local roads of adjacent subdivision developments. Originally the
applicant wanted to locate the sign on Block 103, a future road widening block. Staff

could not support the placement of the sign within a future road allowance. For this
reason the sign was proposed on Lot 27, even though it remains a long distance from
Mearns Avenue. The Applicant notes that because of this distance a larger sign than the
by-law permits is requested so that it can be seen from Mearns Avenue.
3.3 Eventually a 2.4 metre noise barrier fence will be erected along the rear yards of the lots
fronting on Eldad Drive. Once this happens, the sign will be removed as it will no longer
be visible. The Applicant anticipates that by this time, several dwellings will be
constructed and the subdivision will be more noticeable.
3.4 Staff support an increase in size to permit an 8.92 square metre promotional construction
sign in this location for the following reasons:
· A larger sign is necessary to be visible from the nearest main road.
. No other signs are proposed within the development.
· The sign will be removed when the noise barrier fence is erected and before the
dwelling is occupied.
4.0 CONCLUSIONS
4.1 It is recommended that the Sign By-law be amended to permit an 8.92 square metre
promotional construction sign as requested.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 2002-
being a by-law to amend Sign By-law 97-157, as amended of the Municipality of
Cia rington
WHEREAS Chapter M.45, Subsection 207 (146) of the Municipal Act, R.S,O. 1990, as
amended, provides for the creation and amendment of By-laws regulating or prohibiting the
erection of signs and provides for the charging of fees for inspection and/or issuing of permits
and for the pulling down or removal of contravening signs;
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable
to amend By-law 97-157 as amended, of the Corporation of the Municipality of Clarington;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Section 4.4 - EXCEPTIONS is hereby amended by adding the following new
subsection:
"4.4.6 Notwithstanding Section 4.3 Table C, to this By-law an a.98m2 promotional
construction sign may be permitted for Lot 27 in draft plan of subdivision 18T-
89064 within Part Lot 9, Concession 2, of the former Town of Bowmanville.
2. This By-law shall come into on the date of the passing hereof.
