REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF
DECEMBER 5, 1983.

SUBJECT: APPOINTMENT OF MR. RAYMOND GOODWIN AS A
MUNICIPAL LAW ENFORCEMENT_OFFICER, -TOWN OF NEWCASTLE.
RECOMMENDATIONS:
1. That this report be received; and
2. That Mr. Raymond Goodwin be appointed a Municipal Law Enforcement Officer;_ and
3. That the attached by-law giving effect to Mr. Goodwin's appointment be forwarded
to Council for passage.
BACKGROUND AND COMMENT:
Mr. Goodwin commenced his employment with the Town of Newcastle on December 13th
1982. The By-law (82-179) appointing Mr. Goodwin was enacted by Council on
December 13th 1982.
During the past year, the by-law enforcement office has undergone significant
change and under Mr. Goodwin's direction, a number of positive actions have been
undertaken. As the Municipality's By-law Enforcement Officer, he has successfully
prosecuted, or assisted in the prosecution of a number of cases. There have been
times when his role has been affected by the title assigned to the position. To
counter this, Mr. Goodwin has requested, that consideration be given to altering
his title to that of "Municipal Law Enforcement Officer. "
The matter was referred to Mr. Sims for an opinion and, by letter dated August
17th 1983 (copy attached), he responded to the inquiry, Mr. Sims points out,
and rightly so, that the appointment of a Municipal Law Enforcement Officer

automatically carries with it the functional title of Peace Officer for the
purpose of enforcing the Municipality's by-laws. The request for a title change
really relates to the definition in Section 70 of the Police Act. There are
occasions when assistance may be required and the Act defines and establishes
the position of Municipal Law Enforcement Officer. It does not, however, have
anything to say with respect to By-law Enforcement Officers and it is this
anomaly that we wish to have corrected.
It is recommended, that the General Purpose and Administration Committee give
consideration to this request, and forward the attached by-law to Council for
passage.
