RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-113-02 be received;
2. THAT the application submitted by Mr. Kelvin Whalen on behalf of 1064055 Ontario
Limited to remove the Holding (H) symbol for Draft Plan of Subdivision 18T-90032 be
APPROVED;
3. THAT the attached By-law to remove the Holding (H) symbol be passed and a copy
forwarded to the Regional Municipality of Durham Planning Department; and
4. THAT all interested parties listed in this report and any delegations be advised of
Council's decision.

2.0 BACKGROUND
2.1 On October 17, 2002, Staff received a request from Mr. Kelvin Whalen on behalf
of 1064055 Ontario Limited for the removal of the "Holding (H)" provision for
lands within draft plan of subdivision 18T-90032. Attachment 1 shows the
location of the lands subject to the request for removal of holding. Removal of the
Holding (H) prefix will permit the development of 8 single detached dwelling lots
and 3 blocks for 15 on-street townhouse units.
2.2 The applicant has entered into a subdivision agreement with the Municipality for
the development of draft plan of subdivision. The agreement in place covers the
Municipality's financial interest, including payment of development charges.
3.0 STAFF COMMENTS
3.1 The provisions of the Zoning By-law allow for the removal of the "Holding(H)"
symbol, by By-law, upon Council being satisfied that the uses to be permitted will
be adequately serviced, have appropriate access, and will be used for the
purposes intended by the By-law.
3.2 As noted above, the owner has executed a subdivision agreement with the
Municipality and will submit all securities prior to the issuance of building permits.
As such, it is appropriate to lift the holding symbol for the lands within draft plan
of subdivision 18T-90032

A by-law amendment to remove the "Holding(H)" symbol is not subject to the
appeal period afforded to rezoning application, and accordingly is deemed final
and binding should Council's approval be granted.
4.0 RECOMMENDATIONS
4.1 In consideration of the comments noted above, it is recommended that the
removal of the "Holding (H)" symbol be removed as shown on the attached by-
law and schedule (Attachment 2).

Zoning By-law Amendment

CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NUMBER 2002-
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for
the Corporation of the former Town of Newcastle
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Municipality of
Clarington for ZBA 2002-032;
NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "4" to By-law 84-63, as amended, is hereby further amended by
changing the zone designation from "Holding - Urban Residential Type Two
((H)R2) Zone" to "Urban Residential Type Two (R2) Zone" and "Holding - Urban
Residential Type Three ((H)R3)" to "Urban Residential Type Three (R3)" as
illustrated on the attached Schedule "A" hereto.
2. Schedule "A" attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of the passing hereof, subject to
the provisions of Sections 34 and 36 of the Planning Act.
