CD-57-83 - Our File: 77.2.9. SUBJECT: DEDICATION OF ROAD ALLOWANCES, JONES STREET AND ROSE STREET, NEWTONVILLE, AS PUBLIC HIGHWAYS RECOMMENDATIONS: 1. That this report be received; and 2. That the road allowances - Jones t and Rose Street,,, Newtonville, be dedicated as Public Highways; and 3. That the by-law establishing these lands as a municipal highway, be recommended to Council for passage; and 4. That the Clerk be authorized to have the by-law registered in the Registry Office; and 5. That By-law Number 80-125. be repealed, BACKGROUND AND COMMENT: By letter dated August 31st 1983, Mr. David MacGregor, Solicitor, Newcastle, Ontario, wrote inquiring about the status of By-law Number 80-125, which was passed by Council on October 6th 1980. The purpose of the By-law was to "Establish certain lands as a municipal highway. " Subsequent to the passage of the By-law, it was determined that the description was defective and new descriptions were requisitioned from Merrill D. Brown, and received on December 12th 1980. During the intervening years, no further action was taken by the Town. Continued . . . . . /2 r V CD-57-83 - 2 - September 19, 1983. It would be appropriate, that the matter be brought to its logical conclusion; that a new by-law be passed and registered. Rose Street, Newtonville) WHEREAS the Corporation of the Town of Newcastle has acquired certain lands Es S' as hereinafter described and the Council of the Corporation of the Town of Newcastle deems it appropriate and necessary to accept the said lands as I f a public highway; i AND WHEREAS Section 298 (1)(a) of The Municipal Act, R.S.O., 1980, provides i that the Council of every municipality may pass by-laws, "for establishing and laying out highways"; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY r i ENACTS AS FOLLOWS: t 1. That the lands described in Schedules "A" and "B" and laid out on the f 1 sketch illustrating the description of the said public highways and j' described in Schedule "C" attached hereto, being part of Lot 8, f Concession 1, of the former Township of Clarke, now in the Town of Newcastle, be and are hereby accepted and dedicated as public highways within the Town of Newcastle and all by-laws presently in force with respect to highways and streets, shall apply to the highways created under this by-law; i 2. That By-law No. 80425 enacted on the 6th day of October 1980, is hereby repealed. t By-late read a first and second time this 26 day of September 1983.
