CD-45-83 - Our File: 10.2.11. SUBJECT: MEETING WITH NEWCASTLE LAKERS BASEBALL TEAM RE: CLERK'S REPORT CD-41-83 (GPA JULY -4/83) RECOMMENDATIONS: 1. That this report be received; and 2. That the application by the Newcastle Lakers Baseball Team to operate a "beer garden" in Newcastle Park during the period September 3rd to 5th 1983, inclusive, be approved; and 3. That this approval be conditional upon the Newcastle Lakers Baseball Team fulfilling the following conditions: (a) Provide the Town with a policy of insurance in the amount of One Million Dollars in a form satisfactory to the Town, covering the period of the event; (b) Provide the Town with a performance bond in the amount of $1,000.00 in a form satisfactory to the Clerk; (c) Instal fire extinguishers in the Club House for the duration of the event; (d) Provide sanitary facilities on site in accordance with Regional Health and the Liquor Licensing Board requirements; (e) Erect two lines of snow fence around the "beer garden" area and provide the necessary security personnel to maintain the integrity of the beer garden area. 4. Upon compliance with the conditions contained in 3 above, that Council authorize the Clerk to issue a letter to the Club approving the holding of the event and sanctioning the issuing of a special occasion licence for the event by the L.C.B.O. '� Continued . . . . . /2 CD-45-83 - 2 - July 11, 1983 BACKGROUND AND COMMENT: Clerk's Report CD-41-83 was considered by the General Purpose and Administration Committee on July 4, 1983. The decision was "that staff meet with members of the Team and report on the outcome to Council " on July 11, 1983. The recommendations contained in Report CD-41-83 were discussed and clarified. As a result, the Lakers re-defined their request and asked that "beer tent" be read as "beer garden. " Having clarified their request, it was agreed that they were now requesting that Council approve their application for permission to operate a "beer garden" during the ball tournament from September 3rd to 5th 1983 inclusive. The beer garden would be established at the west end of the Club House, the area enclosed with two rows of snow fence to control access, at least six club members would provide the security and beverages would be dispensed into the beer garden area from a window in the west wall of the club house. Mr. Fanning, Director of Community Services was in attendance at this meeting and saw no difficulty with the establishing of the beer garden and the use of the club house. It was agreed by the Lakers delegation, that they would provide the Town of Newcastle with a policy of insurance in the amount of One Million Dollars, a performance bond, or a certified cheque in the amount of $1,000.00 (which would be used by the Town if required) , instal fire extinguishers in the club house for the duration of the event and, provide sanitary facilities on site in accordance with Regional Health and the Liquor Licensing Board requirements. Based upon the assurances and undertakings given by the Newcastle Lakers Baseball Team,staff has no objection to the approval of the application,subject, of course, to the club satisfying the conditions agreed to.
