SUBJECT: REQUEST BY MR. ANTHONY E. LASKOWSKY, SOLICITOR FOR MR. & MRS. SALVATORE RISORTO, C/O 73 CENTRE STREET SOUTH, OSHAWA, ONTARIO, L1H 7149, TO OCCUPY AN EXISTING DWELLING DURING THE CONSTRUCTION OF A NEW RESIDENTIAL DWELLING. RECOMMENDATIONS: 1. That this report be received; and 2. That the application be approved; and 3. That the Mayor and Clerk be authorized to execute the standard agreement with the applicants, to permit them to occupy the existing residence on site, for a period not exceeding six months. BACKGROUND & COMMENT: Mr. Anthony E. Laskowsky, Laskowsky and Neubauer, Barristers and Solicitors, 73 Centre Street South, Oshawa, has by letter dated May 24th 1983, made application to the Town on behalf of his clients, Mr. and Mrs. Salvatore Risorto for permission to occupy an existing residence on site, during the construction of their new home. i The Risorto's have executed an agreement for the purchase of a parcel of land situate on Part of Lot 35, Concession 4, former Township of Darlington. One of the conditions is, that the purchaser obtain assurance from the Town of Newcastle, that they would be permitted to occupy the existing dwelling during the construction of a new residence following which the old residence would be demolished. ter, Continued . . . . . /2 0 ' U, CD-36-83 - 2 - June 6, 1983 The Planning Department has indicated, that they have no objection to the application, subject to the Risorto's complying with all of the Town's requirements with respect to building permits and zoning clearances and on the clear understanding that the approval is for a six month period. Because the closing of the sale is dependent upon their receiving approval of the application from the Town, the Risorto's are seeking Council 's approval as soon as possible in order that the condition in the agreement can be satisfied.
