CD-82-82 - Our File: 77.2. 107. SUBJECT: COMPLAINTS WITH RESPECT TO THE USE OF TRAIL BIKES IN THE TOWN OF NEWCASTLE RECOMMENDATIONS: 1. For the consideration of the General Purpose and Administration Committee. BACKGROUND & COMMENTS: By letter dated November 30th 1982, the Clerk of the City of Oshawa has forwarded copies of letters from two residents of the Grandview/Bloor Street Area of Oshawa , and Townline Road East, Newcastle. Both residents complain of noise generated by trail bikes and the disregard the operators have for the safety of people in the area. The City of Oshawa has responded to the complaint filed by Mr. Edward Judd and have recommended the following: 1. The erection of additional signs on the west side of Grandview Park; 2. The Durham Regional Police be notified of the complaints and requested to provide closer surveillance of the park area in an effort to reduce the use of the area by trail bikers. By-law Enforcement has attempted to deal with the problem of trail bikes in that area of the Town, but to a large degree has been unsuccessful because for the most part, the machines are coming into the area by van and/or are being driven in from Oshawa. Continued . . . . . /2 � `� CD-82-82 - 2 - December 13, 1982 Council , on October 4th 1982, endorsed a resolution of the Borough of Etobicoke with respect to trail bikes and a copy of the Town's endorsation was forwarded to the Borough and the Provincial Government. By letter dated .November 14, 1982, James Snow, Minister, Ministry of Transportation and Communications acknowledged receipt of the Town's resolution. In response to the concerns expressed, he advised that M.T.C. had completed a review of the Ontario Government's position and would be making recommendations to Cabinet shortly. The Minister indicated that any legislation proposed would be in the form of a new act and would not likely become effective until the summer of 1983. He also noted that the Ministry of Municipal Affairs and Housing was prepared to undertake amendments to the Municipal Act which would give municipalities the power to pass by-laws designating areas where such vehicles may and may not be operated. It would appear, that the only avenues available to the Town at this time are: 1. To request Durham Regional Police to increase its patrol activity in the complaint area; 2. Determine the ownership of the lands upon which the "dirt bike racetrack" is situated, and if the Town's zoning by-laws are being contravened, prosecute the owner of the lands for permitting an illegal activity. The Committee may, of course, determine that in light of the impending legislation, no action other than requesting Regional Police assistance be taken at this time. Edward Judd, an Oshawa resident, and Mr. G. R. Flintoff, a Newcastle resident. Enclosed I am forwarding copies of correspondence pertaining to this matter which set out the nature of the complaints, the staff position before Committee of Council, and the action taken by City Council. I refer you specifically to the first paragraph under the comments section of the October 5th memorandum from the Director of Community Services to the Community Services Committee wherein it is noted that part of the problem is in the Town of Newcastle and should be dealt with by the Town of Newcastle. At the request of the Director of Community Services, I am forwarding this material to you in order that you may consider placing the matter before Newcastle Town Council for consideration with respect to Mr. Flintoff's complaint. Nelson , Director Community Services Department ITEM : Correspondence from J . Earl Judd - 1116 St . Andrews Court and G . R. Flintoff - 52 Darlington Blvd . BACKGROUND The City Clerk received letters of complaint from Mr . Judd and Mr . Flintoff regarding the excessive noise , and dangerous. operations of motor bikes and vehicles in the east section of the city in the areas of Grandview & Bloor Streets . This practice has created a dangerous problem for children playing in the area . Also, an excessive noise factor which disturbs the neighbourhood and creates dust and unsightly conditions in the area of the problem . COMMENTS We contacted Mr . Flintoff and visited the area , and. the problem encountered by Mr. Flintoff is not in the City of Oshawa . It is located east of the Townline Rd . S „ and Cherrydown Dr. The area re- sembles a ' racetrack ' , and we believe the complaint should be dealt with by the Town of Newcastle . Mr . Judd was not at home . However , on visiting the site , bike tracks were very prominent on the park on the west side of Grandview St . , north of the C . P. R . tracks . There are two ( 2 ) signs posted in Grandview Park banning the use of motor bikes which are apparently being ignored in a lot of instances . However, we would recommend another sign being placed on the west side of this property which might have some additional control on the problem , RECOMMENDATION 1 . That an additional " NO MOTOR BIKES " sign located on the west side of Grandview Park. 2 . That Durham Regional Police be notified of the complaints received , and they be requested to provide a closer sur- veillance of Grandview Park in an effort to reduce the emu. use of this area by motor bikes , and the resultant noise and dust problems . A 2 Dear Sir; After a number of calls to the Durham Regional Police, regaraing the horrendous amount of noise from trail bikes which are racing through fields at the top of the Oshawa town line where it terminates at the North of Bloor Street, I am concluding that they are powerless to put a stopto I understand that there is no by-law that could prevent this activity, anc to compound this problem bikes are being brought in by vans and trucks fry other areas. Some of these bikes travel over the Grandview area, which is illegal as V. use the roads to approach the field where all the activity takes place. The main objection is the high noise level which persists all summer long and, due to the hill, is amplified. as it is reflected towards Darlington MU Blvd. South. i I, and others in the area would be extremely grateful for any action which would bring this activity to a successful conclusion. Grey Deputy Clerk Town of Newcastle DEC i 40 Temperance Street Bowmanville, Ontario LlC 3A6 Dear Miss Grey: The Honourable William Davis has asked me to reply to your letter of October 5, 1982 in which you advised Premier Davis about the Newcastle Town Council' s support of Etobicoke ' s recent resolution regarding trail bikes . My staff recently have completed a review of the Ontario Government' s position on these vehicles . I will be taking my recommendations to Cabinet shortly. Any legislation that may eventually result would be in the form of a new act since the Highway Traffic Act is not applicable to off-highway use . Such legislation, if approved by Cabinet and sub- sequently by the Ontario Legislature , would not become effective until the summer of 1983 at the earliest. In addition, Cabinet approval to proceed would have to contain authorization for funding necessary for my Ministry to administer an o.ffrhighway vehicle registration system. Further, ' I understand that my colleague , the Honourable­ `Claude Bennett, is prepared to make amenidmeRt§; .$o the Municipal Act in conjunction with the proposed "Off-Highway Vehicles Act" . These amendments would be designed to give munici- palities the power to pass by-laws designating areas where such vehicles may and may not be oper- ated.
